Mr. Xie, Changfa was sentenced for 13 years
On the case of CDP member Changfa Xie, on Tuesday (September 01) morning, No.6 Tribunal, intermediate court of Changsha City sentenced Changfa Xie for 13 years, due to “Overthrowing State Power”.
“Protest is the outrageous act.” Changzhen Xie, Changfa Xie’s younger brother roared on the court.
The sentence lasted 20 minutes and ended. Seven of Changfa Xie’s friends came to audit. One of his friends expressed that he felt startled on the result of 13 years sentence. But, Changfa Xie said nothing about the sentence and his spirit looked worse than the court hearing in the end of April.
CCP authorities considered the act that he participated and organized China Democracy Party and convened China Democracy Party No.1 Conference as the evidence constituting “Overthrowing State Power”.

From his individual subjective opinion, he only would like to constitute China Democracy Party and convene China Democracy Party No.1 Conference.” Our criminal law doesn’t regulate that if you constitute democracy party, constitute China Democracy Party No.1 Conference, or you convene No.1 Conference, you will constitute the criminal of illegal party constitution or of illegal rally. Our criminal law doesn’t have such kind of criminal, and thus we don’t think he constitutes criminal.

Gangquan Ma indicated that Changfa Xie should appeal to the court during the 10-day deadline after the sentence.
Persons in the known unveiled that Changfa Xie’s case has been handled by the Changsha and beyond Changsha department. Presently, Changfa Xie was imprisoned in the Changsha house of detention, however his friends asked about him in the detention house, and they responded no this person.
The verdict indicated that CCP authorities monitored Changfa Xie from 1998 to 2008, lasting 10 years, including his personal activities, places he visited and every act recorded by the monitor.
In 1998, Wenli Xu and Youcai Wang, who participated in constitute China Democracy Party was entitled “Overthrowing State Power” and was sentenced for 10 years. One of Changfa Xie’s friend indicated that CCP authorities obviously considered Changfa Xie CDP main leader, aimed at his sentence to disrupt CDP organization.
