Jun Wang: Rights Defending, Anti-Violence and the 60th Anniversary of CCP’s Seizing Political Power

As I think, the 60 year history of CCP’s taking political power is a history full of rights defending and anti-violence.
The rights defending activities in China emerge continuously
On October 6, more than 100 China Democracy Party members went to hold rally before the China Consulate General in New York: “Strongly protest CCP government’s persecution on petitioners”. This is one of the normal activities held by us. Only in 2009, we China Democracy Party members already initiated 15 times serial activities in name of “The Promoting Year of Rescuing People Suffered Political Persecution”.
People living in the large areas of China have long suffered the persecution under a corruptive system controlled by CCP authority. They not only have no basic human rights, but also have no guaranteed essential living conditions. Workers are laid off. Residents’ Houses are forcefully demolished. The lands relied by peasants to make a living are violently confiscated by government. Retired veterans’ jobs are not guaranteed. Migrant workers can’t get their deserving salary. They are the weak minority in society of China, which means their lives are really difficult. There is no place for them to justify their rights, so they are forced to be petitioners. They hand in materials to express their complaints and tell related departments and media journalists their unhappiness. All their actions to do petition are extremely difficult. In today’s Chinese society, people have no speech freedom. No matter what kind of unjust treatment they have suffered, they can’t revel any to the media, especially some sensitive aspects. During vacations and holidays, petitioners are strictly supervised and restricted. They are administrated collectively. Those who dare to resist will be arrested and sent back to their residence. Under the violent government’s regime, Chinese people can’t justify their rights and are compelled to search for other methods to solve their problems. In contemporary world, there isn’t a second country and government that has to face so many petitioners in such a long term. Though Chinese government sets up petition department and welcome center, which are aimed at dealing with petitioners specifically, these means can’t fundamentally solve people’s petitions. What can they do? Only by realizing a multi-party rule democracy political system, the large scale petitioner problems can be finally solved. Before this moment, overseas democracy movements have to appeal for these suffered people in China. We not only appeal for lower-class people, but also for famous democrats. On January 6, 2009, over a hundred China Democracy Party members came before China Consulate General in New York to hold a rally: “Support ‘Chart 08’ and ask CCP to release Mr. Xiaobo Liu”.
The 60 years under CCP authority’s administration, an autocratic system rules the country for long. The government applies violence on ordinary Chinese people, cruelly oppress and persecute dissents, rights defenders, religionists and China Democracy Party members. Human rights are seriously trampled. CCP government says that they are the government of people and they are a clear government trusted by people. AS a matter of fact, it’s a complete lie to deceive Chinese people. Ordinary Chinese people have no high requirements on CCP authority. They just want the government can ameliorate human rights, treat people properly and officials don’t corrupt. However, the truths are always against people’s wishes. Contemporary Chinese society has large numbers of corruptive officials. The overwhelm scale and huge amount of corrupted money are never seen before. Chinese people are totally disappointed of CCP authority and lose faith in it. CCP authority takes 30 years to do reform and open up. Though the economy in China has developed for some degree, it hasn’t fundamentally changed the autocracy political system in China. CCP authority is a tyrant government utilizing violence and lies for a long time. The government is never trusted and is the most corruptive government in the world. Facing the financial crisis, only by eliminating one-party dictatorship, implementing multi-party democracy political system and establishing a constitutional China, the society of China can be rescued. This is the only choice to CCP.
China Democracy Party members keep on insisting, shouting and protesting for reason that there are too many tragedies and disasters in today’s China, almost over a thousand every day. The most recent one is the violent demolition on peasants in Hangzhou. More than 100 people lost their houses. The forced demolition happened at rural areas of Donghu Street, Hangzhou City, Zhejiang Province. More than 20 families lost their houses in two single days. During the demolition, many house holders are arrested by the CCP authority. The peasants went to petition to all levels of government, but no effect is reached.
The Zhejiang Province government also oppressed many China Democracy Party members. They are arrested at home for 24 hours a day and supervising spots are set outside their homes. The police clearly told them that they will be tracked until the October 1 ceremony is held. The dissent writer Gengsong Lv, who was presently in prison, his wife is 24 hours scouted. Gengsong Lv wrote a book “History of CCP’s Corruptive Officials” during his time in jail and appealed for a system for Chinese citizens to do impeachment. He was sentenced four year in prison by the court of Hangzhou City in February, 2008 at the crime of “Intentional Subversion of State Power”. Petitioner Zhu, Yingdi’s family, China Democracy Party members Yufu Zhu, Qingxiang Mao and Xiaoling Hu couple are also treated and tracked in the same way. Qingxiang Mao was former editor of “Zhejiang Tide and an independent member of Chinese Writer Associate. In November 1999, he was accused of the crime “Subversion of State Power” and sentenced 8 years in jail.
Another China Democracy Party member Yufu Zhu also has the same misfortune. The 57 year old CDP member is the initiator of democracy wall in Hangzhou City. Because of his entangling into democracy movements, he was sentenced 7 years in jail by the court of Hangzhou City. He was released in September 2006. However, he was once again put in jail no more than one year after at crime of “Dispute Public Service”. Though he has been arrested for many times, he never surrenders.
Yufu Zhu loses living resources after he came out of prison. He has applied for low income welfare to Hangzhou Civil Affair Department, but the government deliberately creates difficulties to him. Presently, Yufu Zhu’s 400 yuan living fees are transferred to him through civil security team to him, so that they can control him tightly.
The righteous reason for China’s rights defending movement
In contemporary Chinese society, people have no human rights. The society of China is not a legislation one. The rule of man replaces the rule of laws. CCP officials replace laws. The words of officials overlap the laws and they even show arrogance before the people. They say that CCP is the law. When one is CCP’s leader, he can represent laws. Their faces are totally gangster like.
CCP government plays duplicity on problems of human rights. To win the holding right of 2008 Olympic Games, CCP authority promised international to ameliorate human rights situation in China. Now the Beijing Olympics has been over for one year, but the human rights situation are deteriorating without any better signs. CCP authority still tramples human rights mercilessly. They use cruel means to control people and oppress petitioners. Dissents, human rights defenders, religionists and China Democracy Party members are arrested and put in jail. China Democracy Party hereby appeal for all the people in the world not to be deceived by CCP and recognize it’s ugly true face.
China Democracy Party members always oppose violence and terrorism. We promote democracy, freedom, peace, reasoning and non-violence in order to promote China’s social progress. China Democracy Party member Changfa Xie is a normal citizen, but CCP authority forcefully place the crime “Subversion of State Power” on him. CCP authority should firstly abandon violence and stop persecuting people. We strongly appeal for CCP to release all illegally arrested China Democracy Party members.
Democratic China should respect basic human rights and ameliorate relation between government and the people on this basis. Therefore, we can establish a socials environment respecting and protecting human rights. Rights defending movements not only promote constitutional politics, but also guarantee the deepening of rights defending activities.
Rights defending movements are a lightened route to a democratic China
China Communist Party is a cruel political party and a party damaging Chinese people. Meanwhile, China Communist Party is a party casted aside by all Chinese people and people in the world.
In a tyrant China, people have no human rights, freedom or living guarantee. People’s lives also lack necessary protection. As a matter of fact, CCO is listed as one of terrorism organization in the world. Countries led by communist parties are mostly left behind in the world because they are all autocratic countries. People waking up will naturally abandon CCP. Democratic countries guarantee all for their people. Chinese people actively participate in democratic movements and pay focused attention on the country’s reform. We all care about the future and development of politics in China and hope China to be a democratic country without communist party.
Democratic movements in China are mainly rights defending and anti-violence activities. People protest CCP’s persecution. The emerging “Rights Defending Movements” are an important part of China’s constitutional development. It will absolutely have a significant place in history. I frimly believe that rights defending movements as a new phase of China’s hundred years old constitutional development, will be an enlightened route for a democratic China.

王 军：维权抗暴与中共建政六十周年

我认为，中共建政六十周年的历史，就是一部中国人民维权抗暴的历史。
中国维权抗暴风起云涌
10月6日，100多名中国民主党成员来到中国驻纽约总领事馆前举行集会，“强烈抗议中共政府迫害上访人士”。这是我们经常举行的维权抗暴活动。仅仅在2009年，我们中国民主党人已经发起了15次“中国遭受政治迫害者营救宣传年”系列活动。
生活在中国社会的民众，长期受到中共政府腐败专制制度的迫害，他们不仅没有基本人权，而且还有许多民众的基本生存条件没有保障。工人失业下岗、住房被强制拆迁；农民赖以生存的土地被强行征用；退伍军人的工作得不到保障；农民工的工资长期被拖欠；他们是中国社会的弱势群体，他们的生活十分艰难；又没有地方申冤，只有被迫上访，递交申诉材料，向有关部门或者媒体的记者诉说冤屈，被迫开展艰难的上访维权行动。在当今的中国社会，民众没有言论自由的权利，不管他们有什么不公平的待遇、或者冤屈，都不能向媒体透露。特别是在敏感的地方，节假日，这些有难的上访民众就会被管制起来，集中管理，不从者就会被抓捕、遣返原籍。在这种暴政之下，中国的老百姓有了冤屈不得不上访，被迫寻求解决问题的途径，在这个世界上，没有第二个国家与政府像中国政府这样要面对如此众多、如此持久、如此范围广大的访民。尽管中国政府专门设置了信访局、接待站，所谓专门处理访民的冤屈问题。可是，这种治标不治本的方式不可能从根本上解决民众上访问题。怎么办？只有在中国实现多党执政的民主政治制度，才是解决大规模的民众上访问题的唯一出路。而在此之前，海外的民主运动要为受苦受难的中国民众大声呐喊。我们不仅为底层民众呼吁，也为著名人士呼吁。2009年1月6日，百名中国民主党成员来到中国驻纽约总领事馆前举行集会，“声援《零八宪章》，要求中共释放刘晓波先生”。
中共政府在执政中国的近60年里，长期实行专制统治，对中国民众使用暴力，残酷打压和迫害异议人士、维权人士和宗教人士以及中国民主党人，严重地践踏人权。中共政府口口声声说他们是人民的政府，是人民最信赖、最廉洁的政府。事实上都是欺骗老百姓的谎言。中国的老百姓对中共政府没有什么过高的要求，他们仅仅是希望政府改善人权，能够善待百姓，希望官员不贪污，不腐败；然而，事实与人们的愿望总是相违背的，今天的中国社会，官员贪污腐化人数之多，范围之广，贪污的金额数量之大，实属罕见。中国民众对腐败透顶的中共政府完全失去了信心。中共政府用了30年时间搞改革开放，虽然中国的经济有所发展，但是并没有改变中国的专制政治体制。中共政府是一个长期使用暴力和谎言的极权专制政府，是世界上最不能信任的政府，也是世界上最腐败的政府。在国家金融危机面前，只有结束一党专制，实行多党民主政治改革，建立一个民主宪政的中国，才能挽救中国社会。这是中共的惟一选择。
中国民主党人一再坚持抗议呐喊，是因为今天的中国，有太多太多的悲剧、惨案，每天都会发生千百万起。最近一个实例是，杭州农民惨遭强拆，100余人无家可归。浙江省杭州市东湖街道工农村发生集体强拆事件，超过20户村民的房屋两天之内全部被强拆，期间多位户主被当局软禁。村民到各级政府上访，没有任何结果。
浙江政府同时打压多位中国民主党人，并且予以24小时软禁，家门口增加了监视岗哨，公安明确告诉他们将被跟踪至十一庆典结束。系狱的异见作家吕耿松妻子汪雪娥被24小时跟踪，外出须报告，至十一长假结束。正在服刑的吕耿松写有《中共贪官污吏》一书，呼吁建立中国公民弹劾制度，2008年2被杭州市法院以“煽动颠覆国家政权罪”判处有期徒刑4年。多次声援吕耿松的访民朱锳娣一家三口、中国民主党浙江成员朱虞夫、毛庆祥和胡晓玲夫妇等均受到同样对待，一直被人跟踪。毛庆祥曾是1979年杭州民主墙刊物《浙江潮》编辑，也是独立中文笔会荣誉会员。1999年11月，被法院以“颠覆国家政权”罪判刑8年，2007年9月获释。
另一名浙江民主党创办人朱虞夫日前也有同样遭遇。 57岁的朱虞夫也是杭州民主墙发起人，因从事民主活动，1999年被杭州法院以“颠覆罪”判刑7年，2006年9月出狱。不到一年，被杭州市上城区法院以“妨害公务罪”再度判刑两年。虽然多次被抓，但他从未屈服。
朱虞夫出狱后失去生活来源，他曾经向杭州民政部门申请低保，但当局故意刁难。目前朱虞夫每月的400元人民币生活费由民政部门经国保大队转发，以便加强对他的控制。
中国维权抗暴运动的正当理由
在目前的中国社会，民众没有人权，因为中国社会不是一个法治社会，人治取代了法治，中共政府与官员替代了法律，官员的话语完全可以凌驾在法律之上，甚至还有官员在百姓面前耍威风，说共产党就是法律，他是共产党的干部，他就可以代表法律，他的话就是法律；简直是一副流氓无赖的嘴脸。
中共政府在人权问题上口是心非，为了获得2008年奥运会主办权，中共政府对国际社会承诺要改善中国人权。如今北京奥运过去了一年多，中国的人权状况更加恶劣，没有任何起色，中共政府仍然在践踏人权，而且还变本加厉。采用残酷的手段管制民众，打压上访民众，抓捕异议人士、维权人士、宗教人士以及中国民主党人。中国民主党呼吁全世界人民不要上当受骗，彻底认清中共的丑恶面目。
中国民主党人一贯反对暴力，反对恐怖统治，倡导民主、自由、和平、理性、非暴力的民主理念，并以此来促进中国的社会进步。中国民主党人谢长发是一个普通的市民，但中共当局硬要强加给他所谓“颠覆国家政权”的莫须有罪名。中共政府要做的第一件事情就是放弃诬衊和暴力，停止迫害人民。我们强烈要求中国共产党释放所有遭到不法关押的中国民主党人。
民主中国是尊重基本人权的，在此基础上改善政府与民众的关系，建立一个尊重人权、保护人权的社会环境。维权运动不仅可以促进宪政，而且也只有宪政才能保障维权运动的深入。
中国大陆的工人、农民、军人维权运动
随着经济全球化的深入发展，世界各地的资方日趋占据强势地位，劳方则明显处于弱势地位，在中国这样半市场化的专制国家更加严重。“血汗工厂”和“虐待童工”的普遍存在，中国的劳资冲突已经发展到了一个恶性阶段。劳资矛盾已经成为社会的主要矛盾。作为“维护劳动者权益的代表者”，官方工会陷入了绝境。
工会是保障职工权益的重要组织，工人兄弟遇到利益纠纷、人权受到侵害，工会就应该挺身而出，为工友索回权益！当遇到天灾人祸时，工会要从人道主义出发，为工友解除困难，使得他们重获新生。然而中共一党专政的所谓工会，是官方工会，是与中共一样黑暗腐败的工会。工人兄弟认清工会组织的重要性及中共严格控制工会的黑暗性，要确立民主、人权为主导的独立工会，用行动为实现独立工会而努力奋斗。
允许工人群众自下而上成立独立工会，是现代社会的基本人权之一；在中国大陆，由职工自主组建工会，更是解决劳工问题的根本所在。要做到这一点，一定要破除中共的《工会法》，破除其只有上级工会可以派人帮助和指导企业职工组建工会的反动规定。只有全面成立工人自己的独立工会，才能代表工人利益。
中国现有农民工的总人数大约有两亿人。在目前的中国社会，如此庞大的农民工群体，却是生活和生命毫无保障的群体，面临工资欠缺、社会保障没有、劳动安全和卫生条件极端恶劣等四大突出问题，引发了严重的社会危机和治安纠纷。因此，工会和农会有责任把农民工组织起来，切实维护他们的权利。但是，农民工到底有多少加入了工会或农会呢？他们又将如何维护自己的权益呢？
目前上海地区约有的400万民工中，只有40多万民工的子女正在接受义务教育。其余民工无法将自己的孩子送进公立学校，只好转向私立学校。而私立的民工子弟学校，一直以来就是校舍简陋、师资欠缺，其中许多甚至并未注册。北京地区的教育专家表示，2005年在“新政策”的切割下，132所民工子弟学校遭到勒令停校的命运。但是北京政府并没有将这群流离失所的民工子弟迁至其他公立学校，而是听凭他们流离失所。北京政府为了在2008年奥运来临前，减少北京内的民工人口，不惜采取这样的非人道措施，自然遭到了来自民工子弟学校、专家学者与非政府机构的共同指责。在抗议官方藐视人权的强大声浪下，约12所学校得以重新营运。但是其他被关闭的学校则永远消失了。
中国农民工的悲惨处境是中国农民悲惨处境的一个延伸。很多有志者因此开始深入研究中国的农民问题，希望改善农民的绝望生活。陈桂棣与春桃合着的《中国农民调查》，描述安徽农村的状态具有震撼性。事实上，神州大地1949年以来就没有出现过独立自主的农民。毛泽东这个忘本的农民，对待农民的格外凶残超过了一切反动派。他不仅拒绝改善农民生活，还把大量城市人继续流放到农村，使得中国上演无数的人间悲剧。
中共现役军人共200多万，是当今各国数目最多的军队，但共军实际人数远远不止这些。副师以上“在部队离退休”的政策，不仅使军人数目大增，且将共军变成等级差别最大的军队：副师级是一条鸿沟，副师以上的军官是终身军人，完全由官方终身保持全部待遇；团级或团级以下军官和士兵就是临时军人，早晚要踢出部队，士兵仍然回家种田。那些有过军籍，数目远远超过230万的复员转业军人回到地方以后算什么？他们的合法权利又没有被侵犯？在中国公民的维权运动中他们有什么动作？这是一支真正的“人民军队”——他们的维权运动必将对未来中国的走向产生深远而关键的影响。
在社会不公、贫富悬殊的今天，中共部队军心不稳，成为一个极大的不安因素。尤其复员转业军人的维权活动，伴随示威抗议事件的直线上升，直接动摇了中共政权。全国有规模的群体抗争，70-80%的领袖和骨干都是复转军人。根据2005年10月中共中央办公厅，中央军委办公厅联合下发的《全国复员军官维权服务中心非法活动调查》的中央文件，复转军人组织在各省各地已形成网路化，已形成有规模的组织，2006年全国有104个。显然复转军人的维权活动直接威胁中共一党专政。尽管复转军人的维权上访迄今为止全部遭到压制，但他们的维权行动已经得到现役军人的普遍支持。道理很简单，现役军人面临复转，复转军人的今天就是现役军人的明天。中国社会波涛汹涌的维权活动彻底瓦解了共军的军心。
维权运动是通向民主中国的光辉道路
中国共产党是一个残暴的政党，是一个残害中国人民的政党。同时，中国共产党也是一个被中国人民唾弃的政党，是被全世界人民唾弃的政党。
专制的中国，人们是没有人权和自由的，是没有生活保障的，人民的生命也是没有保障的。实际上，共产党在世界被列为恐怖主义的行列。共产党统治的国家都是落后国家，都是专制国家，所以人民觉醒之后就会自觉的唾弃共产党。在民主国家这一切都是有保障的，中国人民积极参加民主运动，关心中国家的变革，关心国家的政治的未来和发展，使中国能够成为一个没有共产党的民主中国。
民主运动目前在中国主要是维权抗暴的运动、反对中共迫害的运动。近年来兴起的“维权运动”是中国宪政建设的重要一环，将来一定在历史上有其显赫地位。我深信，维权运动作为中国百年宪政建设的最新阶段，是通向民主中国的光辉道路。 （2009年10月13日写于美国纽约）
