Introduction of Qin,Yongmin
Yongmin, Qin, was born on Aug.11, 1953, in Wuhan city, Hubei province. He was a steel worker and a speaksperson in Hubei branch office. He was the chief editor of “The Sound of Bell” magazine in 1979, a leading member of democracy wall in Wuhan, and he was in charge of the “Four Five forum” periodical in Wuhan branch.
In April, 1981. He was arrested in Wuhan for editing illegal publications, and was sentenced seven years in prison. He was arrested and sentenced after his release and he was finally released in 1989. In the middle of November, 1993, he drafted the “Peace Charter” with Guo,Yang and other eight people. The next morning he and Guo Yang were arrested by public security personnel. In the middle of December, he was sent back to Hewan Prison for two years in Wuhan, Hubei.
In March, 1994, he delivered a letter secretly from prison saying he is determined to accuse the illegal custody of government, and demand an open trial. At the end of 1995, he was released after 2 years in prison, borrowing 20,000 RMB to run a bookstore for living. He later put a fridge in front of the door to improve his business but the fridge was confiscated and imposed a $2,000 penalty by force. When he requested the return of his fridge to the local government, municipal officers indicated his store was illegal and demanded his removal or demolition of the house by force.
On June 5, 1997, he wrote a letter to Premier Jiang,Zemin, demanding local authority the grant of right to survival. On Aug 11, he wrote a public letter to Premier Jiang,Zemin again and asked for political restructuring and democratic constitution in 15th Party Congress. In March 1998, he created the “China's human rights observation organization” and applied for registration to the local government. In the later July, he organized “The National Coordination Group” with Xu,Liangying, Lin,Mu, Xu,Wenli, and Ren,Wanding, fighting for the release of the arrested. In early Sep., he launched “Hubei Of China Democracy Party” with Chen,Zhonghe, Lv,Xinhua, Ren,Qiuguang, Xiao, Shichang, Liu, Feiyao, and Gao,Jindong, applied for registration to social club management office of Hubei civil affairs department.
At 9:45 on Sep 24, five police officers from Wuhan public security bureau went to Qin’s home and brought him and Chen,Zhonghe to the local police station, where they claimed the China's human rights observation organization illegal and banned it according to superior instructions. The police took Qin back to his home, searched the house with warrant and took him to custody for 48 hours. At 10 AM on the 28th, Chen,Zhonghe and he applied “China's human rights observation organization” for registration to social club management office of Hubei civil affairs department. The personnel there suggested they would not approve organization like this through the phone. On Oct 26 at 9:00 PM, he was brought to the local police department, for the reason “China's human rights observation organization” was illegal without registration and would be seized accordingly. At 11:00 PM, he was taken home by police, the fax machine and everything relates to “China's human rights observation organization” was confiscated, he was released until the 27th in the morning. On November 5, Chen,Zhonghe and he went to the social club management office of Hubei civil affairs department for registration.
An official there said their competent units have to approve it and a government official has to stand surety for it. “China's human rights observation organization” has no competent unit and therefore was not accepted. On the evening of 30th, the police took Chen,Zhonghe, Xiaoshichang, and him away from home. At 11:00 AM on Dec, 11, two police officers went to Qin,Yongmin father’s home and told him his son was officially arrested for “inciting subversion of the state's political power”. On the morning of Dec 17, intermediate people's court of Wuhan came on for trial. On Dec. 22, he was sentenced 12 years in prison and 3 years deprival of political right. He was held in Hanyang prison. After Qin was arrested, his daughter has lived with the seventy-old father Qin,Qingguo with no income. 秦永敏,1953年8月11日生,湖北省武漢市人,鋼鐵工人,中國湖北省支部發言人。79年間曾任武漢《鐘聲》期刊主編,是武漢民主牆的主要成員,民刊《四五論壇》武漢分社的負責人。81年4月在武漢市被捕,被控編輯非法出版刊物,以「反革命宣傳煽動罪」,被判刑7年。獲釋後也多次被捕及判刑,89年才正式獲釋。93年11月中旬,他與楊週等八人起草了《和平憲章》,翌日與楊週被公安人員拘捕。同年12月中旬被遣送回湖北省武漢河灣勞教所勞改2年。94年3月,他從勞改營偷寄出的一封信中稱,誓要控告政府非法禁錮,並要求公開審判。95年底,他勞教2年獲釋後,向朋友借了2萬元人民幣經營一間小書店,以賣書與租書為生。後來因生意清淡,他在店門口放了一個冰箱,第二天即被武漢市政局人員沒收其冰箱,並強行罰款二千元。當他向武漢市青山區區政府提出歸還冰箱的要求,市政局人員指其擺賣的門面為哒陆êB,並要求他遷出,否則要強行拆屋。97年6月5日,他致函中國國家主席江澤民,要求當局給予生存權。8月11日,他再次致公開信予江澤民,要求在十五大進行政治體制改革,實現民主憲制。98年3月,他創辦「中國人權觀察組織」,並向湖北民政廳申請註冊。7月下旬,他與許良英、林牧、徐文立及任畹町五人組成「全國協調小組」,爭取被捕人士的獲釋。9月上旬,他和陳忠和、呂新華、任秋光、蕭詩昌、劉飛躍及高進勤發起「中國民主黨湖北籌委會」,並向湖北省民政廳社團管理處申請註冊。9月24日早上9時45分,武漢公安局政保處五名公安來到秦家,將他及陳忠和帶到當地派出所,接著公安對秦永敏宣佈「中國人權觀察」組織為「非法組織」,根據上級指示予以取締。公安又將秦永敏押回住處,出示搜查證進行搜查,以及將他拘留了48小時。29日上午10時,他和陳忠和兩人往湖北省民政廳管理處申請註冊「中國人權觀察」組織,但社團管理處負責人通過電話指示工作人員向秦永敏表示,他們將不會批准成立這樣的組織。10月26日晚上9時,他被公安帶到當地派出所,表示「中國人權觀察」組織未經社團登記屬非法,要予以查封。晚上11時,公安將秦永敏押回住所抄家,沒收了傳真機及一切與「中國人權觀察」組織有關的文字資料,並被拘留10小時至27日早上7時才獲釋。11月5日,他與陳忠和往湖北省民政廳社團管理處進行登記。該管理處一名官員則表示申請社團必須要主管單位同意,也即必須有一個官方單位推荐擔保,而「中國人權觀察」無主管單位,故不予受理。30日晚,公安將他和陳忠和及蕭詩昌從家中帶走。12月1日上午11時,兩名武漢市公安局到秦永敏父親家,表示秦已因「陰謀顛覆國家政權」而正式拘留。12月17日上午,武漢市中級人民法院開庭審理此案。22日,他被判刑12年,剝奪政治權利3年,關在漢陽監獄。秦永敏被捕後,其女兒與七十多歲父親秦慶國生活在一起,家人無任何收入。 通訊地址:湖北省武漢市青山區紅綱城 |
