We should carry on civil right struggle to CCP’s urban management

1. What is ＇Urban Management＇
The so-called urban management refers to ＇City Appearance Management Law Enforcement Personnels＇. In Shenzhen, Urban Management is managed by City Appearance Management Office, which is a directly-managed unit by City Management Bureau (Formerly called City Facility Public Management Bureau (a government unit). Units subordinate to City Management Department include: Municipal Management Division (mainly responsible for construction and maintenance of city＇s infrastructure), Water Company, Garden Management Division, Environment Health Management Division, City Appearance Office and Gas Company. These units were all government branches. Since institutional reforms, Water Company, Garden Management Division, Environment Health Management Division and Gas Company were all classified as enterprises.
Don＇t see that urban management has somany official titles. But judged by the people, the nature is crystal clear. The people wrote in ＇Shenzhen Forum＇, it sounds good,but what I saw is a gang of gansters whose job is to beat, smash and rob. Can＇t you see where there are urban management, there is a total mess. Is it said that citizen＇s property can not be violated? It is wrong to put up stalls to sell things at random,however, they rob ordinary people＇s property without issuing a receipt! What are they? Is it urban management＇s job to deprive people＇sright to live?
According to the following introduction and analysis, the urban management is but huligans, bandits and disasters combined, and is a monster formed gradually during the course of urbanization in China. If we don＇t comprehensively reform and further abandon it, China will have not a single day at ease, so do the people.
2. CCP＇s Urban Management is official bandit
CCP＇s ＇urban management＇ is a hligan organization under the protection of dictator government, its huligan stories often shock both China and abroad. Sometimes, even CCP has to penalize it and suppress it in order to cheat the world and and cover up.
In the morning of August 10, 2006, Beijing No.2 Middle Court made the first trial over the Shunyi Gang headed by the twin HU, Ya Dong and HU, Ya Feng. The judge sentenced HU, Ya Dong to 20 years imprisonment with 13 charges including organizing and leading gang and HU, Ya Feng to 19 years with 10 charges. 32 other gangsters were also sentenced to imprisonment from 18 months to 18 years, among whom were a urban management team leader and an attorney. Five policemen involved in this case were not included in the gang organization, but treated in another case. That was the initial settlement of the first Beijing gang since CCP ＇establish government＇.
However, more issues were exposed by this case, for the protector of this gang was CCP＇s urban management team leader and police! After one month＇s investigation, the court only decided the HU brothers committed large scales of crime activities with violence, threats and organization, and formed a gang in the localarea to cheat and mistreat the people and conducted illegal businesses, and ＇ bribe CCP government employees to provide protection and illegal assistance to conduct organizational crimes＇. It did not acknoledge that the CCP urban management and Beijing police were in fact the gang＇s protector and supporter.
In this gang, there was a man called CHANG,You Sheng, who was the team leader of ＇Chunyi District Urban Mangement Supervision Division Gaoliying Team＇. He recruited gangsters into the urban management team to collect money in Shunyi District and Changping District in the name of automobile inspection. CHANG, You Sheng argued he himself did not join the gang, nor did he swindle. In fact the Urban Mangement Supervision Division authorized HU,Ya Dong＇s gangsters in Shunliuhuan Parking Depot to inspect and suspend vehicles, which was government conduct! Many victims confirmed CHANG, You Sheng and HU,Ya Dong together with urban management staff forcibly took their farming tricycles to the parking depot for inspection and swindled money. Three policemen, a public security bureau investigator, Shunyi Detention Office Director participated in the crimes. But theBeijing court refused to trial them. They wanted to wait until this issue was forgotten by the people.
3. CCP＇s Urban Management Is Ptivate Bandit
CCP＇s urban management is an outlaw bandit team. Industrial and business management has its regulations, but urban management does not. Becauseof this, they connect with officials and form a private troop. They are private bandits.
These irrational gansters do everything they want and commit unbelievable crimes. Take the HU case for example, on August 5, 1996, when HU,Ya Dong was running the Shunyi Dongdong Auto Repair Factory, he was not happy with ZHANG, Guo Li of Village Du Aoto-repair Factory, who decreased repair factory＇s business. Hu asked YAO,Shun Yong and others to stop ZHANG, Guo Li and beat him up. During the beating, ZHANG, Zhen Yu injure of ZHANG,Guo Li＇s hip and cut off half of ZHANG,Guo Li＇s right ear.
At noonof October 7,2002,when HU,Ya Dong ran away with a charge. Because he was unhappy with ZHENG, Hong Bo who wanted to reconcile with ZHANG,Guo Li. He ordered his followers to stub ZHENG＇s abdomen and caused critical wounds to ZHENG,Hong Bo.
On June 5,2004, in order to help ZHHU, Ya Dong to be elected Shunyi District Beixiaoying Town Qianliwu Village Committee Director, HU,Ya Dong gathered many followers to make trouble and seriously affected normal election activities.On June 8,2004, HU, Ya Dong learned villager YIN,De Fu showed disatifaction with their conducts, so Hu ordered LI, Ming Zhi and others to take YIN, De Fu out of his home to a small restaurant and asked for 200,000 RMB. When in vain, he detained YIN＇s car for more than 10 days.
In January 2005, HU,Ya Feng issued 200,000 high interest loan to LIU, Zhao Xu. HU deprived LIU＇s house when LIU failed to pay off the high interest loan, forcing LIU and his pregnant wife flee out of their home.
All things like above were done under the protection of CCP police. Without CCP urban management＇s cooperation and assistance, the private bandits as individual gang could not grow up and develop in the socialist society.
4. CCP Urban Management Is the Root of Disaster
CCP＇s urban management is the root of disaster, its evil bahavior damaging the mask of ＇Harmonious Society＇. One case can illustrate this point.
At 5:00 p.m. of August 11,2006, at Zhongguan Village,Beijing. His tricycle being confiscated by the Haidian Distrct urban management, the 23-year-old CUI,Ying Jie had a quarrrel with urban management staff and afterwards he threw a knife into the throat of Mr.LI, Zhi Qiang, Deputy Team Leader of Haidian Distrct urban management team. At 6:00 in the afternoon,LI died when allmedical efforts failed.
During the first trial, the persecutor played the video shot at the scene, the most important evidence of this case.The picture shows that more than 10 law enforcement staff surrounded CUI,Ying Jie,who was waving his knife instinctly and speaking softly: you just leave the tricycle for me and take everything else. Urban management staff said put down your knife, put down your knife. The last scene of the quarrel was that CUI knelt down on the ground with one knee and his left hand taking his tricycle firmly. ＇I begged them. They could take everything with them. Please just left my tricycle with me, because I had just bought the day before with borrowed money,＇ CUI, Ying Jie described his feeling at the moment. Urban management finally took over the tricycle and withdrew and the video tape showed they were leaving the scene. Suddenly the already left CUI, Ying Jie jumped into the picture from behind,then some chaos in the crowd, then blood, then CUI turned around and ran quickly toward the end of the lane. CUI＇s explanation to the fatal attack was,＇ I felt very painful at the time seeing the tricycle loaded ontothe truck. I saw the other guy could get back his tricycle at the last minute,so I went forward again. When I passed by LI,Zhi Qiang,his hand touched mine.I thought he was going to catch me,so I threw off my arm. I did not know where the knife went into.＇
On November 27, Beijing Investigation Bureau charged CUI,Ying Jie with intentional murder. On December 12, 2006, the murder case started trial process in Beijing No. 1 Middle Level People＇s Court. There was a great divergence as to whether death penalty would be sentenced to CUI, Ying Jie. This was because everyone knew the roof of disaster was CCP＇s urban management, whose evil bahavior damaged the mask of ＇Harmonious Society＇.
Obviously,this case is becoming the target for the Chinese society to criticise the urban management system. Even the CCP criminal specielists thought CUI, Ying Jie＇s case was not intentional murder. Infact,both CUI, Ying Jie and LI, Zhi Qiang were the victim of the urban management system,which is encouraging fight and murder among the people themselves.
5. CCP＇sUrban Management Is the Tomb-Digger
When things go extreme,they turn to the opposite. Urban management＇s tyranny will objectively accelerate CCP＇s decline. The urban management system is the tombe-digger. Today it dug tomb for LI,Zhi Qiang, tomorrow will be for CUI, Ying Jie and in a final analysis will be for CCP Central Committee itself.
Should CUI,Ying Jie face death penalty? Of course not! Because he is also CCP＇s tomb-digger.
The decisive factoraffecting this case＇s trial is whether ＇Urban Management Enforcement Bureau＇ is legal itself or not. LI,Zhi Qiang was regarded as die on duty and was rewarded martyr by the Beijing government. But whether the enforcement institution islegalhasbecome a new suspicious point.Attorney XIA, Lin doubts the legality of Beijing Urban Management Comprehensive Administrative Enforcement Bureau＇. He thinks although ＇ an administrative institution＇ is stipulated by law to be able to enforce powers,this institution must be one legally established. According to relevant laws,such an instituion must be reported by the government of the same level to the State Council for approval and file to the same level of the Stansding Committee of People＇s Representative Assembly. XIA,Lin told the reporter that investigation shows that Beijing Urban Management Comprehensive Administrative Enforcement Bureau had not gone through these procedures at establishment!
This means now that prosecutor charges CUI, Ying Jie with hinder public duty, he must first prove that Beijing Urban Management Comprehensive Administrative Enforcement Bureau is a legally established administrative institution. Huadong Politics and Law University professor LIU,Song Shan expressed that urban management confiscation of small businessmen＇s operational property prohibiting their commercial activities constitutes an administrative permit for this behavior,which should be authorized by law. Therefore whether an administrative institution has the authority to issue this permit or not is a question which involves the legality of government powers.
6. How to resist CCP＇s Urban Management
How to resist and punish urban management＇s illegal activities? There are several solutions to be summed up as follows:
1). Remember urban management employees＇ features. Violence for violence when necessary. Try to stop spread of urban management＇s wrongdoings.
2. Try searching for urban management employees＇home address. Go to their homes and move them. Exert this balancing influence and diminish its evil nature in the society.
3. Promote citizen appeal. Encourage people of all levels and call for CCP＇s removalof urban management. Social security is subject to management by the legal system and not at the wills of administrative authority. Only when the Chinese society is connected with real democracy and order of law can risks of social turmoils be illiminated and long peace and security attained.

Gone with the evil urban management in China!
The people can enjoy peaceful and happy lives! The people will live their lives with dignity!

王军：对中共城管要进行维权斗争
一、什么是“城管” ？
所谓“城管”是指“城市市容管理执法人员”。在深圳，城管属于市容管理办公室管辖，而市容管理办公室又是城市管理局（以前叫市政公用管理局）的一个直属单位（事业单位编制）。市管理局下属的单位目前包括：市政管理处（主要负责城市市政基础工程的修建和维护），自来水公司，园林管理处，环境卫生管理处，市容管理办公室，燃气公司等单位！以前这些单位属于事业单位，自机构改革之后，自来水公司和园林管理处，环境卫生管理处和燃气公司都划为企业。
不要看城管有这么多官方头衔，但是在人民群众看来，事情的本质就一清二楚了。在“深圳论坛”上，群众写道：“说处好听，可我看到的是一群土匪，干的是打砸抢的活。君不见，城管所到之地，一片狼藉。不是说公民的财产不得侵犯吗？乱摆卖不对，可他们抢平民百姓的私有财产，连收条都不打！算什么东西？难道城管的工作就是不让人活下去吗？”。
根据我们下文的介绍和剖析，所谓城管，其实是流氓、土匪、祸根的综合体，是中国大陆城市化过程中逐步形成的怪兽，如果不对称管本身进行综合治理并进而彻底杜而绝之，中国将国无宁日！民不安生！
二、中共的城管是官匪
中共的“城管”是专制政府庇护下的流氓组织，其流氓事迹往往震惊中外。有时连中共自己都不得不忍痛割爱、予以镇压，以便更好地欺世盗名、掩人耳目。
2006年8月10日 上午，北京市二中院对胡亚东、胡亚风兄弟为首的顺义黑帮作出一审宣判。法官以组织、领导黑社会性质组织罪等13项罪名数罪并罚判处胡亚东有期徒刑20年，其弟胡亚风因犯10项罪名被判处有期徒刑19年。该团伙其余32人也分别被判处1年6个月至18年不等的刑罚，其中包括一名城管队长和一名律师。由本案牵扯出的5名警察没有被列入黑社会性质组织，而是另案处理。至此，中共“建国”以来北京首个黑帮犯罪组织初步结案。
但是此案却暴露了更多的问题。因为这个黑帮的保护伞就是中共的城管队长和警察当局！经过一个月的集中审理，法院仅仅认为，胡氏兄弟以暴力、威胁手段，有组织地大肆进行犯罪活动，称霸一方，为非作歹，欺压、残害群众，以黑养商，“通过贿赂收买中共国家机关工作人员，并在其提供的庇护和非法帮助下，实施有组织犯罪”，而没有承认中共的城管组织和北京警方其实已是黑社会的后盾和帮凶。
在这个黑社会团伙中，有一个“顺义区城管监察大队高丽营分队队长”，名叫常有生。他让黑社会加入城管队，以查处泔水车为名，在顺义区、昌平区勒索大量钱财。对此，常有生辩解，自己没有参加黑社会，也没有敲诈勒索，确实城管监察大队委托胡亚东的顺六环停车场人员查扣泔水车，此行为是政府行为！ 但多名被害人证实，常有生与胡亚东等人伙同城管队员，以检查泔水车为名，将他们的农用三轮车强行扣到停车场，勒索赎金。还有三名警察、一名公安局预审员、顺义看守所长，伙同他一起犯罪。但是北京市二中院却对他们网开一面，拒不宣判。只等风头一过，就可以大事化小，小事化了。
三、中共的城管是私匪
中共的城管是一支没有法源的、无法无天的土匪队伍，工商管理还有个工商管理法，但是城管组织却无法无天。正因为如此，他们在勾结官匪成为一家的同时，又是一个私人部队，是私匪。
这批丧心病狂的家伙，黑白两道通吃，犯罪情节令人发指。就以胡案为例，1996年8月5日，胡亚东在经营顺义东东汽车修理厂期间，因不满杜庄屠宰厂汽车修理班张国立减少了在修理厂的业务，指使姚顺勇等人拦截张国立对其进行殴打。其间，张振宇用餐刀刺伤张国立臀部，并将张国立右耳廓二分之一割掉。
2 002年10月7日中午，胡亚东负案在逃期间，因不满郑洪波曾欲为张国立调和而怀恨在心，指使手下用尖刀猛刺郑的腹部，致郑洪波重伤。
2004 年6月5日，胡亚东为帮助赵建国当选为顺义区北小营镇前礼务村村委会主任，纠集多人滋事，严重影响正常的选举活动。同年6月8日，胡亚东在得知该村村民尹德福曾对他们的行为表示不满，遂指使李明志等人将尹德福从其家中带到一餐馆内殴打并索要20万元，索要未果后将尹某的轿车扣留十余天。
2005年1月，胡亚风以刘朝绪的一辆斯太尔牌拖挂车作抵押，向刘朝绪发放20万元高利贷。后因刘朝绪无力偿还所剩高利贷，胡亚风强占了刘朝绪的房屋，致使刘朝绪及其怀孕的妻子被迫流离失所。
凡此种种，都是在中共警察的庇护下干的。没有中共城管官匪的配合扶植，作为个体户的黑社会的私匪，是无法在社会主义社会成长壮大的。
四、中共的城管是祸根
中共的城管是祸根，其恶劣行为破坏了“和谐社会”的面具。这里有一个案例可以说明这一点。
2006年8月11日下午5点，北京市中关村。由于维持生计的三轮车被海淀城管队员没收，23岁的河北小贩崔英杰与城管队员发生争执，随后用小刀刺进海淀城管分队副队长李志强咽喉部位。当天下午6时左右，李志强抢救无效死亡。
一审中，检方当庭播放了城管大队宣传科工作人员王金波在事发现场拍摄的录像资料，这被认为是崔案中最为关键的证据。画面显示，十几个执法人员围绕崔英杰周围，崔英杰手里紧握小刀本能地舞动，口气却软弱：把车给我留下，其他你们拿走。城管的声音在说，你把刀放下，把刀放下。争执的最后场面是崔英杰单膝跪地，左手仍死抓住三轮车不放。“我哀求他们，什么东西都可以拿走，就是请把我的三轮车留下，因为那是我头天刚刚借钱买的”。崔英杰在庭审中形容当时心情。城管最终收缴成功开始回撤，画面中是他们离散的背影。已经离开现场的崔英杰突然从后面迅速跃入镜头，人群一阵混乱，然后是血，然后是崔英杰转身飞快跑向小巷深处的蓝色身影。对于这一致命动作，崔英杰作出的解释是“当时非常心痛，看到三轮车被装上卡车的那一刻，看到卖新疆卖哈密瓜的人在最后关头还能要回车，我就又冲上去了。和李志强擦肩而过时和他的手碰了一下，就以为他要抓我，所以随手一扒拉，当时不知道扎在什么位置”。
11月27日，北京市检察院一分院以故意杀人罪对崔英杰提起公诉。2006年12月12日，北京海淀区城管干部李志强被害案在北京第一中级人民法院一审开庭。围绕判不判崔英杰死刑问题，产生很大分岐。因为大家都知道，中共的城管是祸根，其恶劣行为破坏了“和谐社会”的面具。
很明显，崔英杰案正在成为中国大陆社会舆论声讨城管制度的靶子！甚至连中共的刑法学者都如此厌恶城管制度，以致于认为崔英杰的故意杀人案不成立。其实，不论崔英杰还是李志强，都是中共城管制度的牺牲品，中共城管制度挑动群众斗群众，迫使两方群众为了自己的生计自相残杀！中共城管制度是祸根。
五、中共的城管是掘墓人
物极必反，城管的暴行客观上会加速中共暴政的瓦解。城管制度这个掘墓人，今天掘了李志强的墓，明天还要掘崔英杰墓，但最终必将掘掉中共中央自己的墓。
刺死北京城管的小贩崔英杰当杀不当杀？当然不应该杀！因为他也是中共的掘墓人！
影响此案判决的要素，还有个“城管执法局”本身是否合法的问题。李志强之死被称为殉职，并被北京市政府授予烈士称号。但执法的行政机关是否合法成为一个新的疑点。夏霖律师就对北京城市管理综合行政执法局的合法性表示怀疑。他认为，尽管法律规定可以由“一个行政机关”综合行使权力，但这个行政机关显然是指合法成立的行政机关。根据有关法律，省、自治区、直辖市的人民政府的厅、局、委员会等工作部门的设立、增加、减少或者合并，由本级政府报请国务院批准，并报本级人民代表大会常务委员会备案。夏霖告诉记者，经其调查，“北京城管综合行政执法局”的成立本身，根本就没有经过这一程序！
这就意味着，既然控方指控崔英杰妨害公务，就必须先证明北京市城管综合行政执法局是一个合法成立的行政机关。华东政法大学教授刘松山则表示，城管把小商贩的经营性财产予以没收，禁止他们再从事这方面的经管活动，实际上是对这个行为设置了行政许可，而行政许可应当依法授予，所以行政机关到底有没有权力设定这个行政许可就是一个问题，这涉及到政府权力的合法性问题。
六、如何抵抗中共城管？
如何抗拒和惩治城管的非法活动？我们的结论归纳起来有以下几条：
1、记住城管人员的特征，必要时以暴制暴，尽力阻止城管恶行的蔓延。
2、努力搜寻城管人员的家庭地址，对其单刀直入、个人感化，发挥制衡作用，消除其社会毒素。
3、推动公民上书，发动各阶层人民，大力要求中共取消城管，社会治安由司法系统统一管理，不可由行政当局为所欲为。中国社会必须与民主法治真正接轨，才能消除社会动乱的潜流，真正做到长治久安。
我们殷切希望：
中国的恶劣城管不再存在！
人民可以安居乐业！过上有尊严的生活！
