Jun Wang: Democratic China can Avoid Jia Yang’s Tragedy (One)

There can’t be justness in China under one-party autocracy
I will analyze Jia Yang’s case from building up democratic system. We firstly feel Jia Yang’s case is our Chinese sadness, and is China’s sadness, and also is Chinese police’s sadness, and is CCP’s sadness. Why? If Chinese government is a responsible government, Jia Yang’s tragedy will not happen. If China’s courts have justice on cases, Jia Yang’s tragedy will not also happen. But why does Jia Yang’s tragedy happen?
Jia Yang’s case should be not serious. He is Beijing person and went to Shanghai travelling, and then he borrowed a bike. The police said there was some problem on this bike which was stolen. Then they argued. Police have power and they beat his. Attackers have not been punished, so Jia Yang wanted to have a justice. In fact what Jia Wang wanted is law justice. But can is there law justice? CCP’s one-party autocracy decides that there can’t be law justice or law independent.
Experiences prove police are so crude to common people
A bike caused so big incident. I want to tell my own experience. When I was an army officer, I wore PLA sea army white clothes and cap and was very smart. I came to hometown to visit my families. Many friends invited me for lunch, and said these were schoolmates meetings. Some of my schoolmates had been managers or bosses. In order to make myself look smarter, I went to haircut store. This can keep army’s good outlook. This is a very normal thing.
The day had not been dark, and was just not bright. When I was having my hair cutting, police came. They looked fierce and brought guns. Pistols and submachine guns. Joint defence teams. They wore miners’ cap and brought wooden sticks and walked around. When they came to me, police asked whose bike? I said it’s mine. I rode bike. At that time, where were no motor-bikes or cars. It’s stolen! He said. This bike is not stolen. It is my families’. This bike’s No. card was belong to Wuxi. My hometown is Yixing. My families drove a truck to deliver, and punched other’s bike. My families said I give you money, and you give me your bike. I buy it.
Police said I stolen the bike without any evidences. I explained repeat, then I phoned my families to prove this bike is my families, and it is not stolen. There were no explains in police, because I argued with them. In eyes of Chinese police, common people have no dignity. You can’t speak normal or justice words, or you can’t express your own opinions.
I contradict the police, the police are very vicious. They came in and wanted to capture me. I have to warn police, I would say that I am a military reporter, I did not break the law here, I just made a rationale, I just need to break the law of military tribunals to try me, you do not have the qualifications I tried. If you do have to hit me, then I will sue you. I am the People＇s Liberation Army, my duty is to defend the country, to defend the people, if I can’t defend themselves, I am not a soldier, I told you do in the end.

以下是王军的发言整理：
一党专制下中国不可能有公正
我从建立民主制度这个角度来讲讲杨佳这个事情，我们首先觉得杨佳这个事件是我们中国人民的悲哀，是我们中国的悲哀，也是中国警察的悲哀，也是中共自身的悲哀。为什么这么讲呢？假如中国政府是一个负责任的政府的话，杨佳式的悲剧是不会发生的。假如中国的警察是负责任的警察的话，杨佳式的悲剧也不会发生。假如中国的法院是执法公正的话，杨佳式的悲剧也不会发生。那么为什么会发生杨佳式的悲剧呢？
杨佳这个事件本来很小的，他是北京人，到上海去旅游，然后借一辆自行车，警察说这个自行车是有问题，偷来的，然后发生口角，警察有权、有人，把他打了。打人者，没有受到任何惩罚，所以杨佳提出要讨公道。其实杨佳讨公道的真正的涵意就是司法要公正。可是在中国怎么会有司法公正呢？共产党一党专制，他的性质决定在中国不可能有正义、有司法公正，也不可能有司法独立。
亲身经历证明警察不把老百姓当人
关于自行车引起这么大祸，我讲一个我亲身体会。有一年当时我还在解放军部队当军官，我穿着解放军海军的白色的军装，戴着大白帽，非常神气，好好的到了家乡探亲以后，很多朋友请我客，说同学之间见见面，我的同学已经是当了经理、总裁了，我为了更加威武一些，到理发店去理理发、刮刮胡子，保持军人的仪表，本来是一个很正常的生活上的事情。
结果，那时天还没有完全暗，就朦胧的暗，傍晚，我正在理发的时候，警察长得凶魁，拿着枪，小枪还有微型冲锋枪，然后联防队，戴着以前矿工戴的帽子，然后拿着大棒子走路，晃来晃去的。一到我面前警察就跟我讲：“这个车子谁的？”我说：“是我的。”我也骑着自行车，那个年代没有摩托车也没有汽车。“偷来的！”他下个定义。唉！我这个车子怎么会是偷来的呢？是我家里的。因为当时这个车子是无锡的牌子，而我老家是宜兴。当时我的家里人到无锡去，开了个大卡车送货，把人家车子碰坏了，那我家里面就说干脆我给你钱，你把车给我算了，就算是买他的车。
警察在毫无根据的情况下就说是你偷来的。我再三解释，然后打电话给家里证实，这个车是我家的，不是偷来的。警察很不讲理在哪里呢，因为我跟他辩解了，在中国的警察眼里，你老百姓就不是人，你就不能讲人话，你就不能讲正气的话、正义的话，你就不能表达你自己的观点。
我顶撞这个警察了，警察非常的凶狠，上来就要抓我。我得警告警察，我说我是军队的记者，我在这里没有犯法，我只是理一个发，我就是犯法也需要军事法庭来审判我，你没有资格审判我。假如你今天要动手打我，那我先告你。我是解放军，我的职责是保卫国家、保卫人民，假如我自己都保卫不了的话，我就不是一个军人，我跟你干到底。
他一看我这个来头也不小，没敢动手，他说：“证件。凭什么说你是军人、军官？”我说：“你的证件呢？凭什么说你是警察？”他说：“我戴着警察帽、穿警察服、带着枪。”我说：“我也是戴着军官帽、穿着军官服啊，我们是公平的。你要查我的证件我首先要查你的证件，我怎么相信你是警察？因为你敞胸袒怀的不像警察的样。所有的行为像流氓一样，像地痞一样。”他说不过我，我当记者的，他说不过我，他知道自己理亏。他马上下令其它警察：“带走！”要把我的车拿走，还要把我带走，然后我急了我赶快找了一个人，我说你赶快给我打电话告诉我家里人。组织人员营救我！
我家里一个电话组织了三十多辆摩托车，包围了派出所。这个所长到现在我记忆犹新，叫邵见其。到了派出所以后，这个所长拍着桌子讲话。我说：“警察先生，我不是犯人，你不可以这样对我的。”他拍得更凶，他想，到了这里还有你说话的余地啊？老子说了算。后来呢，这个教导员是原来山东胶州湾的的一个胶南地区的军人，他跟我原来这个邻居也是个军人，是战友。
他一听说我是在山东当兵，他就劝我：“唉呀，地方啊，就这样，算啦，别跟他们计较啦，计较你要吃亏的，言外之意你要吃亏的。假如你走不出这个派出所，你可能死在这里。但是当时因为我的乡亲、我的同学、我的朋友全部包围了派出所，让派出所感觉到这一家肯定有来头，没有来头不敢这么硬。好了，到了第二天，我们有一个远房亲戚，是政法委书记，就管他们的，打电话到派出所找那个所长，还有另外一个公安局的副手也打电话给那个所长，这个所长不服那个副手，但是书记打电话，他要服他手下，书记告诉他：“假如没有这个事，赶快把自行车还给人家。假如有这个事，你要先向我汇报的。”
所长觉得这个事情不好办，他就没敢对我下毒手，但他内心非要把我置于死地不可。后来过了几天，这个所长淫威大发，他不服气，他在没有请示汇报的情况下，叫两个警察到我的驻地，让我到派出所报到，假如我不去，要强行扣我去。这个情况非常严重。
后来呢，我们就组织一些人员陪我去，警察很鬼，一看我派头也很大，他也不敢轻易动手。最后，无奈的情况之下，我提前结束了我的探亲之行，回到了部队。假如我不回到部队，可能连命都没有了。大家想一想，假如我的幕后没有这个政法委的书记在撑腰的话，这个警察可能不会让我离开这个派出所，他会为非作歹，杨佳就是少了一个政法委的书记坐背后，假如有，警察不会这样对他。
后来在部队里面也经常出现。有一个干部，有一次回到家乡，跟当地的政府讨公道，最后被活活打死的消息。为什么呢？部队里面讲的是正面的教育，要主张正义，一切都按照法律办事，共产党这个宣传讲的很好听，可是他不做，你真的要去主张正义的时候他就搞你，说把你打死就打死。
所以部队经常出现这样子的情况，最后军官也很灰心，感觉共产党也在耍部队的军官。为什么？我们保家卫国，说是很光荣的事情，可是家里有难，受到侵害的时候，他们要讲真话的时候，就被当地的警察活活地打死。这些贪官、当地的地痞无恶不做，最后不了了之。这种事情后来是司空见惯。
