To Establish Federal Republic of China CDP, CDPWU Spring Festival Proclamation of 2009

2008 was a disastrous year which has just passed in which China was offered five unprecedented “presents”: 1. Natural disasters (southern snowstorm, Wenchuan Earthquake, southern flood); 2. Man-made calamities (Jiaoji Railway Train Collision, Xiangfen Dam Collapse, Longgang Fire Disaster); 3. Turbulence (Weng’an Mass Turbulence, Tibet and Xinjiang Turbulence, Yangjia’s Killing Policemen, Longnan Mass Turbulence, Chongqing Taxi Driver Strike); 4. Health Crisis (Extremity Ostium Illness Epidemic Situation, Sanlu Poisonous Milk Incident, Guangyuan Orange Disaster); Economic Crisis (Global Financial Crisis, China Stock Market’s Wild Down, Real Estate Crisis, and Exporting Enterprises Closing Down Crisis). Negative energies that had long been accumulated were released violently within over 360 days, forming an unprecedented “Chinese Disaster Cluster”.
2009 Spring Festival is approaching. At this winter end and in this last month of the year, we China Democracy Party, China Democracy Party World Union extend our warmest blessings and greetings to our dear brothers and sisters, parents and local villagers and relatives throughout China. Let us make our efforts together to ensure our own rights and interests and promote progresses in China in the coming year!
In order to promote this progress, we have already collected 5,000 USD which we donated to Chinese democrats who are in Chinese prisons and right-maintenance person who suffered CCP persecution, including their families. Under the stern circumstances of current financial crisis, it is more necessary to carry out actual actions to take care and love these victims. Of course this is very hard to be done. However, we have done it sincerely! We will try our best as usual to donate and deliver our love! Chairman Jun Wang emphasized repeatedly: “To donate and deliver our love is to support Chinese democratic cause. It is also the best patriotic deed! We hope all of us show concerns for those who have made contributions to democracy and freedom! Since they are striving to work for the future of China! They sacrifice their own freedom for the freedom of our nation. We can never forget them! We will always learn from and respect these warriors who selflessly struggle for freedom!
In a blink, the powerful, influential, solemn and stirring 1989 Democratic Movement is already celebrating her 20th birthday. Over these 20 years, we have made many great progresses but we still have many shortcomings. In 2009 we will vigorously commemorate the 20th Anniversary of the 1989 Democratic Movement, and we should take actual action to support right-maintenance movement and religious freedom, and spread democratic philosophy. Chinese democratic movement needs to establish goals, recognize situations, expose CCP, awaken people, form organizations, and establish democratic country!
Presently China is at a historical crossroad, facing again the problem of “Where to go”. After 30 years growth, Chinese economy has experienced obvious slide-down: companies closing down, workers laid-off, farmers losing their lands, all kinds of social conflicts are getting more and more intensified and approaching the critical point of the breakout.
There are many anniversaries worthy of our remembrance: 90th Anniversary of May 4th Movement, 60th Anniversary of CCP’s National Establishment, 50th Anniversary of Great Famine, 30th Anniversary of Xidan Democratic Wall, 20th Anniversary of June 4th Incident, 10th Anniversary of Falungong…
At the close of this crucial moment, the 《2008 Charter 》was released on December 8th, 2008. In 2008, just on the eve of the 60th anniversary of “The People’s Republic of China” (1949-2009), the replaced horn has blown out: a democratic document similar to A General Outline of PRC’s Establishment has come into being.
《2008 Charter》 is a big event in this crucial historical moment of Chinese society’s transference currently. The Charter, which is based on universal human right criteria, proposes 19 creeds to the Chinese government on amendments in constitution, jurisdiction independence, freedom of speech and human right protection etc. It calls for all Chinese citizens with sense of responsibility, regardless of ranks or social status, to jointly promote changes in the Chinese society. Until now, there are more than 8,000 people have endorsed and supported the《 2008 Charter》, and the majority of those subscribers are domestic Chinese. Under the circumstances of CCP authority continuously suppressing right-maintenance movement, people are still signing in their real names to fully demonstrate their long for social and political revolution in China.
《2008 Charter》summarizes Chinese experiences within the century from 1908 to 2008. It is the essence of drawing on the wisdom of the masses. Beijing writer Qisheng Jiang, who was arrested and sentenced after June 4th in 1989 said, “In the process of the drafting and signatures of 《2008 Charter》, I was one of those who had known and participated in it. The earliest draft I had was dated January 17th, 2007, which was the 2nd year anniversary of Mr. Ziyang Zhao’s death.” Since then, the draft has experienced many transformations during two years. On November 14th, 2008, the version was finally named 《2008 Charter》. On the eve of World Human Right Day on December 10th, 2008, there were 303 first group subscribers promulgated solemnly to the whole world。
《2008 Charter》 is not isolated, but with a historical heritage. On December 21th, 2006, Chairman Jun Wang publicly released an article entitled 《From Right-Maintenance Movement to Democratic China》, which shows outstanding vision and significant leading meaning. It is of great value in that it proposed as early as December 2006 philosophy of “Centennial Constitution” and “Establish Country Democratically”, which are exactly the similar as 《2008 Charter》 (published on December 8th, 2008). Chairman Jun Wang led over 100 members of China Democracy Party to demonstrate in front of CCP’s Consulate General in New York to protest against CCP’s persecution of subscribers of 《2008 Charter》.
This is support and encouragement to 《2008 Charter》 as well as a warning to CCP authority: Do not suppress subscribers of 《2008 Charter》. We China Democracy Party members have already proposed such creeds of democratic constitution, and we are the strong backup force of 《2008 Charter》.
《2008 Charter》 pointed out that the “New China”, which was built in 1949, is a nominal “People’s Republic Country”, but in essence, it is “the Party’s world”. The governing party has monopolized all political, economical and social resources and produced a series of human right disasters including The Anti-right, Great Leap, Cultural Revolution, June 4th, suppressing civil religious activities and right-maintenance movement, which resulted in dozens of million people’s deaths. Both citizens and the nation have paid extremely lot for that. 《2008 Charter》 clearly advocates that “to establish the Federal Republic of China under the structure of democratic constitution”.
The following day when 《2008 Charter》 was spread abroad, Chinese scholars overseas and people from various circles all responded positively. Yingshi Yu, Jin Ha and others all showed support in the form of open letter with affixed signature. They claimed publicly that 《2008 Charter》 is a “collective expression of people’s political opinions which has been rarely seen in recent years”, which let us see “the awakening of civil rights consciousness, promotion of courage and enhancement of strength in China”. It is hoped that “Chinese authority can listen to the call of the society and envisage people’s will, accept good advices, and launch systematic reforms advocated in 《2008 Charter》. This shows the consciousness of “construct country democratically” is on the upsurge and has become the “common creed” for people with lofty ideals both inside and outside China. What our consistent wish is to let a new China--the Federal Republic of China replace the decayed and downfallen “the People’s Republic of China” as soon as possible.
“The Federal Republic of China” did not come into being all of a sudden, nor did it come from nowhere. As early as January 31th, 1994, also out of collective wisdom, a 《Constitution of the Federal Republic of China》 was created. It solemnly declared that “In order to terminate autocratic politics in Chinese history, change the central power system, establish rule of law, safeguard citizens’ freedom and rights, promote benefit for all the people, maintain peace and well-being for all nationalities and regions, hence this Constitution is made.”
It is prescribed in Chapter I of 《Constitution of the Federal Republic of China》: “The Federal Republic of Chinese sovereignty belongs to all its citizens…All nationalities of the Federal Republic of China has their rights to maintain and develop their own cultures, religions and languages.”
It is prescribed in Chapter II of 《Constitution of the Federal Republic of China》: “People of the Federal Republic of China are all equal before law and enjoy no difference based on sex, origin, language, race, religion, property, parties and groups, or political opinions. People’s personal freedom is not subject to violation. Except legal stipulation on arrests of criminals, no one is subject to arrest or detention without juridical or public security institutions. Without legal procedures followed by court, no one is subject to interrogation or punishment. Arrest, detention, interrogation and punishment without following legal procedures should be refused and investigated. When a citizen is arrested to detention for criminal suspect, the arresting and detaining institution must inform the reason for arrest and detention to the citizen himself or his family members and relatives who is named by the citizen. It must be transferred to jurisdiction court proceedings within time limit as stipulated by law. The citizen or others can also apply to this jurisdiction court for interrogation from the detention institution within the time limit as stipulated by law. The court cannot refuse such an application. And the arrest and detention institutions must not refuse or delay court interrogation. Citizens’ residence is not subject to violation. No one can render forcible entry or search without legal procedures’ permission”.
The Federal Republic of China is a China which respects its own people, is a real People’s Republic country!

United States Secretary of Homeland Security: Punish employer severely to contain illegal immigrant

[China Democracy Journal](Article/Zhong Yan) The forthcoming 3rd United States Secretary of Homeland Security Janet Napolitano, who is currently the governor of the state of Arizona, pointed out that Homeland Security would review [Real ID Act] in the hearing of the Congress Senate aiming at its nomination case, and would contain illegal immigrants from the angle of punishing employer severely. Not long ago, Napolitano subscribed [Real ID Act] jointly for implementation on behalf of Arizona with current United States Secretary of Homeland Security Michael Chertoff to make Arizona meets the standards of [Real ID Act] for state driver’s licenses or ID cards.
Napolitano pointed out that the Immigration Law in 1986 cannot be trusted by people was because the principles of punishing employer are not well established and actually carried out in workplace. Napolitano stated that as a governor, she subscribed the strictest punitive law to punish employers, and she emphasized that the employer should not abuse illegal immigrant employee.

Number of Chinese students graduated from America has multiplied and H-1’s was halved [China Democracy Journal] (Article/Zhong Yan) After the consulates of the American Embassy in China and some relevant representatives reviewed the trend of study-abroad in the past 2008, they made a relevant prediction to the new trend of 2009 to study-abroad: half of the overseas students cannot get H-1 visa. A student who studied his graduate course of Statistics in Harvard University told journalist: “In the past years, the graduates from our department who haven’t got their graduates’ certificates were already received hiring notice basically from a couple of investment banks. But this year’s investing is bleak and whether one can find a financial job in America is also a problem. It is such a pressure to me!” According to statistics, from 2007 to 2008, the number of interns of Chinese students who were graduated from America has increased from 41,660 of last year to 56,766. In light of the information which was released from American Citizen and Immigration Service Department, till 7th, April, 2008, they have received a number of 163,000 H1B applications; however, the quota of releasing H1B is only 85,000, which means there will be nearly 80,000 people who submitted H-1 application cannot get the visa.

Siblings abstained from food to save their mother for not being repatriated

[China Democracy Journal] (Article/Zhong Yan) Two Nicaragua-America kids from Florida were on hunger strike from 26th to stop their illegal immigrant mother’s repatriation by authority.
According to the reports from “newKerala.com”, these two siblings were Cecia Soza and Ronald Soza, and they indicated that they will abstain from food in Fraternidad Americana which supports immigration from 26th. This organization also sued President Barack Obama to the highest federal court on behalf of 600 children of whose parents had similar situations on 28th, and required to stop repatriating these parents. When the 32-year-old mother Marisela Soza sent her daughter to school on 19th of last month, she was arrested by ICE on her way home. Marisela has appealed to immigration judge but was told she was about to be repatriated on 29th. 12-year-old Cecia said: “We refused to eat is to save mother out and ask President Obama to release her, because she was not a criminal.”
But the 9-year-old Ronald wrote in the petition letter that he and his sister were in tragic situation and they needed mother’s care after she was arrested. Ronald said that he found his mother was disappeared after he went back from school, “and now we are just like orphans”. The executive chairman of Fraternidad Americana Nora Sandigo stated: “We appealed the authority to help their mother, the president has right to intervene, and we hope they can put it into action as soon as possible.”
The two kids’ father has concealed in other place for avoiding being arrested.

[B]Constitution of Federal Republic of China
(Propositional Protocol)
[Main Drafters: Yan , Jiaqi etc.][/B]

Specially establish this constitution for ending up the autarchic regime in Chinese history, change centralism, establish rule of law, ensure people’s freedom and right, promote all people’s well-being, and protect peace and welfare among all ethnic groups and among all regions.

Chapter 1 General Rules

Article 1 Federal Republic of China is federal republic of freedom, democracy and rule of law.

Article 2 Federal Republic of China’s sovereignty is belonging to all citizens.

Article 3 People who have citizenship of Federal Republic of China is Federal Republic of China’s citizen.

Article 4 Federal Republic of China is made up of autonomous state, autonomous province, autonomous city and special administrative region (Hereinafter referred to: state, province, city, and region).

Article 5 All ethnic groups in Federal Republic of China have the rights to preserve and develop their culture, religion and language.

Chapter 2 People’s Basic Right and Obligation

Article 6 Citizens of Federal Republic of China are all equal in law, there will not any differences between each other due to gender, born, language, ethnic group, religion, possession, party and political opinion.

Article 7 Personal freedom of citizen is not allowed to be violated.

Article 8 Residence house of citizen is not allowed to be violated; anyone who has not been allowed by statutory procedure cannot forcibly enter or search the house.

Article 9 Citizen cannot be judged by martial law except active soldiers.

Article 10 Citizens have freedom to reside and move. Autonomous state and special administrative region have to manage of immigration and departure in its state and region in terms of each state and region’s circumstances.

Article 11 Citizens have the rights to make speeches, give lectures, write works, publish and run news media.

Article 12 Citizens have the rights to communicate secretly.

Article 13 Citizens have the rights to rally, associate, parade and demonstrate.

Article 14 Citizens have the rights to organize political parties and open political activities. Political parties must be conforming to laws and regulations. Political parties’ sources of funding and financial expenses must be reported in accordance with the law.

Article 15 Citizens have religious freedom.

Article 16 Citizens are free to choose their occupation.

Article 17 Citizens have the rights and freedom to organize labor union, participate in trade union and strike.

Article 18 Citizens have the rights to access to information.

Article 19 Citizens have the rights to petition, complaint and litigate.

Article 20 Citizen who is over 18 years ole has the right to vote, and who is over 20 years has the right to vote.

Article 21 Citizens’ possession right should be safeguarded.

Article 22 Citizens have the rights and obligations to be educated.

Article 23 Citizens have the obligations to accept military service.

Article 24 Citizens have the obligations to pay taxes in terms of law.

Article 25 Citizens who do not interfere with social order and public interest, their rights and freedom will all be ensured by constitution.

Article 26 All free rights listed above cannot be restricted by law except for preventing the necessities of impeding the freedom of others, avoiding urgent danger, maintain social order and promote the interests of society.

Article 27 Once civil servant breaks the law and violate people’s freedom or rights should be responsible for crime and civil liability except for being punished by law. The suffered citizens can request for compensation on their damage to country.

Chapter 3 Federal Agencies

Article 28 Federal Republic of China includes: Inner Mongolia autonomous state, Taiwan autonomous state, Tibet autonomous state, Xinjiang autonomous state, Ningxia autonomous state, Guangxi autonomous state; Shanxi autonomous province, Shandong autonomous province, Sichuan autonomous province, Gansu autonomous province, Jiangxi autonomous province, Jiangsu autonomous province, Jilin autonomous province, Anhui autonomous province, Hebei autonomous province, Henan autonomous province, Qinghai autonomous province, Shanxi autonomous province, Hainan autonomous province, Zhejiang autonomous province, Hubei autonomous province, Hunan autonomous province, Guizhou autonomous province, Yunnan autonomous province, Heilongjiang autonomous province, Fujian autonomous province, Guangdong autonomous province, Liaoning autonomous province; Shanghai autonomous city, Tianjin autonomous city, Beijing autonomous city; Xianggang SAR, Macao SAR.

Article 29 Those rights which are not regulated by federal constitution should be exerted by federation and maintain the exerting right from each state, province, city, region and all citizens.

Article 30 Each state institutes constitution by itself. Each province, city and region establishes their basic law by themselves. State constitution and basic law of provinces, cities and regions must not contradict state constitution or violate each state, province, city and region’s lawful constitution.

Article 31 The following items are established and implemented by federation:

(1) Diplomacy, declaration of war and peace;
(2) Nationality;
(3) National defense and military affairs;
(4) Federal financial and taxes;
(5) Federal law and judicial systems;
(6) Senator selection of national council;
(7) Federal public servant system;
(8) Federal police officer system;
(9) Management of federal customs and immigration and departure;
(10) Management of aviation, shipping, inland shipping, national road and state-owned railway that beyond state, province, city and district;
(11) Establishment of federal central bank and publication of national currency;
(12) Management of postal service and telecommunications;
(13) Supervision of measuring and national survey statistics;
(14) Protection of copyright, patent, trademark, and other intellectual property;
(15) Items of regulating other state, province, city and region.

Article 32 The following items are established and implemented by each state, province, city and region themselves:

(1) Law and judicial system;
(2) Education system;
(3) Ways of selecting federal senator;
(4) Management of agriculture, forest, shepherd, fishing, mining, industry, commercial and service industry;
(5) Finance and taxes;
(6) Land system and nature conservation;
(7) Management of labor, social welfare and social service;
(8) Installment and supervision of doctors, sports and cause of leisure;
(9) Encouragement and protection on science, technology, culture and art;
(10) Management of banking and financing;
(11) Management of public and cooperated cause;
(12) Supervision of charities and public welfare;
(13) Activities of religious organizations and social groups;
(14) Police officer system;
(15) Civil servant system;
(16) Region autonomous system;
(17) Other items that not belong to this constitutional regulation are administered by federation.

Article 33 Autonomous state has right to establish non-military protocol with foreign countries with the name of “some autonomous Chinese state”, and to decide to attend all kinds of international organization by itself and establish foreign representative institutions.

Article 34 Federal governments can send delegates and establish institutions in each state, province, city and district.

Article 35 Military alliance and protocol cannot be established among each state, province, city and district.

Article 36 The establishment of state, province, city and district has to be consented with three fourths of federal institutional senators. Any changes take places in state, province, city and district have to be approved by legislature, and be authorized by two thirds of all senators.

Article 37 Before 2050 B.C., HongKong and Macao SAR have right to publish its own currency, issue its passport, travel document and visa, establish its final court, manage post, telecom, protect copyright, patent, trademark, and other intellectual property with foreign countries with the name of SAR of Federal Republic of China to establish non-politic, non-military protocol, and take part in non-political, non-military international organizations to set up foreign trade and economic cooperation office. HongKong and Macao SAR’s financial are independent and are free to pay state tax. HongKong and Macao SAR are authorized by federal council to manage civil aviation and shipping. The status of HongKong and Macao SAR is reviewed according to the regulation of Article 36, Item 2 of federal institution in 2050 B.C.

Article 38 Taiwan autonomous state has right to publish its own currency, issue its passport, travel document and visa, establish its final court to manage aviation, shipping, post, telecom, protect copyright, patent, trademark, and other intellectual property. Taiwan autonomous state financial is independent and is free to pay state tax. Taiwan autonomous state has right to maintain armed forces and reject federal garrison.

Article 39 Tibetan autonomous states is the national nature protection district, and forbid experiment of nuclear, chemical and stocking of biological weapons inside this field. Tibetan autonomous state financial is independent and is free to pay state tax. Tibetan autonomous state has right to establish its final court. After 25 years of implementation of this constitution, the status of Tibetan autonomous state would be reviewed by local citizens’ vote, and not be restricted by Article 36 of this constitution.

Chapter 4 Congress

Article 40 Federal Republic of China Congress is the highest legislature. Federal Republic of China Congress is made up of National Council and Federal Institution, implement legislative power jointly.

Article 41 There are 501 Senators in National Council, distribute to each state, province, city, district according to proportion of population, but there will be at least one person in each state, province, city and district. Senator of National Council occupy for 4 years on condition of serial selection.

7th Edition

Reversion chance of to-be-deported immigrants greatly reduced

[China Democracy Journal] (Article/Zhong Yan) Minister of Justice Michael Mukasey suddenly announced before his departure that immigrants who are in the process of deportation cannot appeal or ask for retrial to deport order with reason of lawyer’s carelessness and deceit. The interpretation to the basic right of constitution becomes effective on 8th, January, which caused strong rebound in field of immigration lawyers and condemned Bush authority stabbed immigration interests before its left, and also deprived immigrants’ last hope of who hadn’t got legitimate agent from lawyer and meanwhile suffered from deportation.
The temporary decision that Mukasey made on 7th, January caused regional federal courts are forced to change the way they used to do. That is to say, since 8th, those immigrants who are already in the process of deportation, the appealing and retrial would be rejected by judge with reason of lawyer’s carelessness. Hence, if someone misses appearing date, fail to hand in new evidence in time, incorrect information fail to correct in time only because of lawyer’s carelessness, immigrants cannot shirk the responsibility to lawyer formally and then switch to another lawyer to open the case.
Ministry of Justice interpreted that because the constitution doesn’t endow illegal immigrants who are in the process of deportation the rights to turn to lawyers, and then they have no qualification to sue their lawyer in the last minute. But meanwhile, Ministry of Justice still has the right to decide whether retrial needed or not.
Law Enforcement Department director of American Immigration Law Foundation Nadine Wettstein indicated that decision Bush authority made before his left deprived immigrants’ rights and nowhere for them turning to while deported. She thought this kind of constitution right cannot interpret by Minister of Justice.
New York lawyer who accepted many Chinese immigration cases indicated that this decision has greatly reduced chance of compensating case loss. He pointed out that many immigrants sued to local lawyers’ management institution with reason of lawyer’s carelessness all the time, and under this circumstance, the judge would agree that those immigrants are victims of failure of lawyers. Therefore, immigrants are permitted to challenge deportation order and make their last efforts for staying in America. Gaotai thought that this decision would influence a large amount of people.
Wettstein also indicated that in the community of Spanish and Chinese immigrants, since lots of immigrants don’t understand American judicial process and complex immigrant regulation, they are often treated inappropriate agency by lawyer and it is more obvious in metropolitan areas.

Deport illegal immigrant immediately once they serve enough time for the sentence
[China Democracy Journal](Article/Zhong Yan) New United States Secretary of Homeland Security Janet Napolitano indicated on 29th, January that Immigration law enforcement agencies will enhance the information sharing in local jails and federal immigration law enforcement agencies so that immigration law enforcement officials can deport illegal immigrant immediately once they serve enough time for the sentence.
Napolitano indicated that she was now investigating the current immigration law enforcement measures. Her aim was to deport those illegal immigrants who committed criminal actions to reduce tax-payers unprovoked burden. Napolitano pointed out that she hoped the information of those imprisoned criminals’ who were in the federal, state and regional jails could more appropriate share with immigration law enforcement department, so that the immigration law enforcement officers could deport them immediately once they serve enough time for the sentence.
According to statistics, there are 26 counties’ prisons in America for sharing information in terms of stipulations, and the information of these imprisoned illegal immigrants can send to immigration law enforcement department’s computer immediately. The subordinate department of National Security ICE indicated that this plan would expand facilities of information sharing with jails and house of detention in the next four years. In the past few years, ICE has strengthened inspecting illegal immigrant and intensified measures of deportation. Only in the last year, America has deported more than 113,000 criminal illegal immigrants. It is believed that there are over 450,000 criminal illegal immigrants still stranded in America.
Napolitano also expressed except for accelerating deportation of those imprisoned criminal illegal immigrants, National Security would strengthen inspecting those escaping immigrants.

Illegal immigrant cannot enjoy tax-reduction
[China Democracy Journal](Article/Zhong Yan) According to US Congress, there are totally 8,910 billion stimulating economic program under consideration, those illegal immigrant who doesn’t have social security number cannot obtain tax-reduction. Republican Congressman are afraid of this bill would grant those illegal immigrant enjoy government’s tax-reduction. Last year, stimulating economic bill regulated that most workers salary-takers can get tax-rebate checks. At that time, the strongly objection from Republican and Conservatives has ever pushed Democratic Party Congress leaders to join more strict tax-rebate qualification, and regulated it is a must to have exact effective social security number to get tax rebate.

He said: “We call the action of tax-rebate from people who haven’t paid income tax ‘tax-reduction’; it cannot be changed into real tax-reduction.”

The Necessity to Remove the Chinese Communist Regime

The Chinese Communist Regime not only harms Chinese people, but also harms people in the world. In China, that regime, consisting of Communist bureau leaders occupying less than 1 million people or 0.1% of the whole population, grasps by force all the resources like the land and minerals given by God for people to live to make money for themselves, and do not give any welfare like housing, food or medical care to people. Those who largely agree on the ideas of this article please feel free to spread or publish it to make the world better.
The Communist Regime also establishes its monopoly by force or by the bayonets in many trades like housing, school, hospital, media, and communication. For instance, as a common people in China, if I want to run a school or run a newspaper, the police send me to prison. Then that regime sets the prices in their monopolized trades very high. The average income for all those who are eighteen years old in China in 2009 is around 400 RMB or 60 U.S. dollars a month. And the Communist Regime sets the tuition and fee of college around 10,000 per year, which is over twice of people’s average income. While over 98% of Chinese people struggle to stay alive, the bureau leaders of that regime make tons of money. In 2006, 3000 descendents of the Communist high officials hold 2 trillion RMB of wealth, with each of them having 670 million RMB, or 90 million U.S. dollars. As a result, in 2009 in China 0.4% of the population hold 70% of the wealth there.
That regime harms the world in two ways. One is its causing the global warming. As above mentioned, by grasping gall the land by force and imposing heavy tax and fees in the country, it forces millions of peasant to work in those poorly conditioned and poorly paid factories controlled by it. Those workers often work 60 hours a week and just get 800 RMB or 120 U.S. dollars a month. As a result, today lots of merchandise in the world is made in China, and China became the largest greenhouse air emitting country in 2008. In the 1980s, China consumed about 5% of the world’s energy every year. In the 2000s, it consumes over 30% of the world’s energy every year. The earth cannot sustain an increase of 25% of the energy consumption.
The other way that regime harms the world is the security. It has been supporting the dictators, the militants around the world, giving them the guns, the ammunition and the more advanced military technology. In China, that regime has some 3.3 million troops, which is more than the troops of Russia and America combined. What does it want to do? Evidently, just defending a country does not need that many troops at all.
In sum, the Chinese Communist Regime, consisting of less than 1 million bureau leaders in China, has been robbing Chinese people and harming people in the world to satisfy their unlimited material greed. Thus, it is necessary not only for Chinese people but also for people in world to remove that regime.

Is Federalism Really Scary?
The statement on federalism cannot be the evidence of CCP’s arresting subscribers of <Charter 2008>

The author thinks: It is a problem that can be discussed for no matter what federalism is. The statement on federalism cannot be the evidence of CCP’s arresting subscribers of <Charter 2008>. It is not scary of the discussion on federalism, but the prohibition on this discussion.
If federalism is scary, then my German life would be the federalism. There are many people live in the United States, which is also carries out federalism, and we cannot say that we are live in such a awful country.
Decades of years ago, that is my first time to read <Suggestible draft of Federal Republic of China Constitution> (Page 28-35, March, 1994, <Opening> Magazine, Hongkong), which is written from Mr. Yan, Jiaqi. If you readers have chances, you can find the constitutional draft from Yan, Jiaqi to read carefully, and compare with the differences between Yan, Jiaqi’s constitution and the Federal Republic of China’s.
People’s respect cannot be violated. Any social, country, or even people from all levels are all equal to each other, their respects are not allowed to be violated. In a family, to father, I am firstly be a man, then is your son; in a country, to king, I am firstly be a man, and then is your subject.
No matter whether it is with lawful theory level and if it is valued of < Suggestible draft of Federal Republic of China Constitution > and <Charter 2008>, and regardless of whether federalism fit in with China or not, at least, the question of federalism, namely “Chinese problem”, is discussable. We cannot say that it is splitting up China once we talk about federalism.
As described above, federalism is one kind of composite system in national structure. As a matter of fact, the composite system has been through a long period of time in Chinese history, even to the current reality. In a broad sense, it is also composite system, if it is not the case, then what Hongkong is since 1997 and Macao since 1999? Hongkong and Macao don’t belong to China? “One country, two systems” is actually a kind of federalism.
In that we all understand a major principle that one-party dictatorship is not long-term solution, so why we cannot discuss federalism?

1,200 Immigration Group Promote Immigration Reform

[China Democracy Journal](Article/Zhong Yan) There were 1,200 groups which supported immigrant wrote a joint letter to the President Obama and National Security Council Secretary Janet Napolitano to implement immigration reform as soon as possible.
It is indicated in the letter that the success of an immigrant Kenya’s son is a realization of American dream. The commitment of immigration reform is proposed during the Obama’s election, and immigration community unprecedented voted enthusiastically. This letter appealed new government to correct Bush government’s loss of the last 8 years, for example, mopping up illegal immigrant by only focusing on law enforcement in the workplace, should not imprison and repatriate legal and illegal immigrant, and “No-match letters” which bring inconvenience to employer. Besides, legal immigrants’ application cases overstocking result in immigrant families cannot have a reunion.
These 1,200 groups are suffused 37 states, Columbia special region and Porto Rico. In addition, “Contact website of national immigrants and refugees interests” wrote a public letter which was subscribed by 2,200 groups and some individuals to the President Obama, requiring him to stop mopping up, imprison and repatriate immigrant during the first 100 days’ inauguration, and hoped Obama’s new government could adopt humane policy.
This letter also urged Obama to cooperate with Congress and hold immigration hearing as soon as possible.
However, because of the current economic crisis in America, and Senator Edward Kennedy, who was the drafter of general immigration reform bill, has already withdrawn from judicial committee immigration group, the future of immigration bill is still hard to predict.

Constitution of the Federal Republic of China
(Continued 2nd, Edition)

Article 42 Federal state is made up of senators from each state, province, city and district: four from autonomous state, three from autonomous province and city each, two from special administrative region. The way how to generate is decided by each state, province, city and district. The tenure of state senator is six years, reelect a half of senators every three years. All CFR citizens who have reached the age of 30 have the right to serve as federal state senator.

Article 43 National institutes and federal institute establish chairman and deputy each, who are selected by and from senators. Federal parliament hold assembly automatically twice every year: the first assembly is beginning at the first Monday of every year’s March; the second one is start with the first Monday of every year’s September. The number of present senators which is over one half is the statutory numbers.

Article 44 National institutes and federal institutes have to obey the Premier to hold temporary meeting. The requirements from national institutes or federal institutes of over one fourth senators have also hold temporary meeting.

Article 45 Federal parliament senator cannot be arrested or detained except for the permission of institutes in addition to the existing criminals.

Article 46 Two institutes of parliament exercise the following powers jointly:
(1)    Legislative powers listed in Article 31 of the constitution;
(2)    Investigate federal budget and final accounts;
(3)    Ratify federal foreign treaty, decide a declaration of war and peace, general and partial mobilization;
(4)    Decide national or partial proclamation of martial law;
(5)    Decide amnesty;
(6)    According to the Premier, require to investigate whether autonomous state and special administrative foreign treaty is disobey federal constitution or not;
(7)    Other power that the constitution authorizes.

Article 47 Federal institutes exercise the following powers independently:
(1)    In terms of Article 36, ratify the establishment and alteration of state, province, city and district;
(2)    Ratify the boarder movement of state, province, city and district;
(3)    Impeach Federal Premier, vice-Premier, state councilor, minister and federal judge;
(4)    Agree to assign the Premier to nominate federal judge.

Article 48 When act of federal budget is submitted to the Congress to deliberate, the Congress can’t propose to increase outcome. Case of federal budget must be deliberated by federal institute after being approbated by State Council. If the budget case has been approbated with the same form after brought forward within 3 months by the two houses, it has to be retreated for State Council’s reconsideration immediately; if that case is approbated by over half of all the senators’ support, and then this case is announced to be passed. Law cases and other bills have to be approbated by the two houses with the same form to complete legislative procedure. If is necessary, senators of the two houses have to propose to assign delegates to organize and coordinate committee, and the decision of committee should be sent back to each house for voting the whole case.

Article 49 The Congress bill is announced by the President after it is approbated. The President should announce the bill within ten days while received.

Article 50 The organization of national institutes and federal institutes should be regulated by law.


Chapter 5 President

Article 51The President is the head of state; he represents the Federal Republic of China. The President of the Federal Republic of China is elected by senators of State Council two houses and voter organizations which are made up of executive chiefs from each state, province, city and district. The Presidential candidate should be a Chinese citizen with over 40 years old. The Presidential election is assembled by State Council senator, and the election should be exercised within the 30 days which 60 days before the tenure of the federal president is fulfilled or absent.

Article 52 The tenure of each president is four years and may be reelected consecutively for one time. The president exercise the following power according to law:
(1)    Subscribe and issue law approbated by state council;
(2)    Appoint premier according to national institute’s decision;
(3)    Appoint and recall vice premier, state commissary and minister in terms of the premier’s request;
(4)    Dismiss national institute according to the regulations stipulated in Article 56 and Article 59;
(5)    Subscribe and abrogate foreign treaty according to congress decision;
(6)    Declare war and peace according to congress decision;
(7)    Accept foreign legate, send and recall foreign legate according to premier’s request;
(8)    Grant country with honor according to premier’s request;
(9)    Issue act of grace according to congress decision; issue order of special amnesty, remission and power recovery according to premier’s request;
(10)     Issue national order of general and partial mobilization and announce martial law and deregulation according to congress decision and premier’s request. The president issues law and order which should be attached with subscription of national premier.

Article 53 If the president involve the action of infraction of law or dereliction of duty, the president will be proposed from one third of the joint session of the congress and be impeached by three fourth of them. The impeached president should be dismissed immediately.

Article 54 When the president is absent, the federal institute exercises the power on behalf of the president. The acting time cannot exceed two months. During this period of time, the new president election will be mastered by senator of national institute.


Chapter 6 State Council

Article 55 The State Council is the highest federal executive branch. State Council establishes one premier, one vice premier, some state commissaries, some ministers together to form federal state meeting.

Article 56 After the election of national institute, or the distrust case was passed through national institute, or step down or absent for some reasons, the premier will be elected by national institute automatically, and the one who was supported by over one half of all senators will be the new premier; if the voters haven’t exceeded one half, the next vote will be kept going between the two highest candidates, the one who gets higher votes will be the new premier; if no one gets over one half of votes, then the election keeps going; if there is still no one is elected within ten days, the president should dismiss state council immediately and reelect.

Article 57 The vice Premier of the State Council, the state councilor, minister should be put forward by premier to be passed from national institute’s deliberation, and be appointed and recalled by the president.

Article 58 The State Council premier exercises the following power: preside over state meeting; according to regulations of federal constitution and law to establish administrative regulation, issue decisions and orders; bring forward bill into congress; command federal army; appoint and recall federal official according to law; nominate judge candidate to federal institute according to law.

Article 59 State Council premier responsible for national institute according to the following regulations:
(1)    The premier presents regular policy addresses to the national institute. The premier and state meeting senators have the obligation to answer senators’ consultation during the national institute meeting;
(2)    If the important bill or budget case which is issued by the premier is vetoed by national institute or amended by unacceptability of premier, it has to be amended by state meeting and be reviewed to national institute. If it is passed by one half of all senators, the result is kept as the original decision, the premier should bring propose resignation or issue president to dismiss national institute;
(3)    If national institute issues distrust case to national institute premier, the case should be subscribed jointly by one fourth of all senators and be passed by over one half of all senators’ consent. The national institute should elect new premier immediately according to regulation of Article 56 after the national institute passes the distrust case. The ex-premier should submit his resignation after the new premier is elected. If the national institute cannot elect new premier within ten days after distrust case is passed, then the president should dismiss national institute immediately and reelect.

Article 60 State meeting exercises the following power:
(1)    Decide to bring forward law case, budget case, martial law case, amnesty act case, general mobilization case and partial mobilization case to federal congress;
(2)    Decide to put forward case of declaration of war, declaration of peace and treaty;
(3)    Decide to grant with special amnesty, remission and power recovery;
(4)    Decide to interfere with issues of departmental committee;
(5)    Decide issues of proposal of the president, vice president, state councilor and minister;
(6)    Establish relative issues with stipulated items in Article 31.

Article 61 During the federal parliament stand prorogue, if the country encounter military intrusion, natural disaster or sudden major accident and needs to deal with immediately, it is the president to issue urgent command to dispose, and submit to the congress after one month of order announcement. If it is rejected, then this urgent command is ineffective.

Article 62 The organization of State Council is regulated by law.


Chapter 7 Judicial System

Article 63 Jurisdiction belongs to federal court and every court in state, province, city and district. Federal establishes common court, appeal court and the highest court, and the organization is regulated by law.

Article 64 The judge of federal court should exercise power independently according to this constitution and federal law, and no one interfere with it.

Article 65 Each state, province, city and district establish law to organize judicial branch independently to exercise jurisdiction of every state, province, city and district. Every state, province, city and district should respect each other’s jurisdiction.

Article 66 Federal court is the highest court. Except the additional regulates of Article 37, Article 38, Article 39, federal citizen equally have the right to institute legal proceeding according to law in each state, province, city and district, and every court of state, province, city and district cannot discriminate residence that do not belong to the above-mentioned place.

Article 67 During the case on trial of the highest federal court, the applicant should be according to the following to explain federal constitution, federal law and order:
(1)    One fourth of federal institutes and national institutes senators subscribe jointly;
(2)    The Federal Premier;
(3)    Chief executive of each state, province, city and district, the highest judicial branch;
(4)    Federal court of appeal and common court.

Article 68 Federal court exercises the following jurisdiction:
(1)    Supervise the litigation of federal congress election, the President election and the Premier election;
(2)    Supervise the litigation between state and province, city and district;
(3)    Supervise the litigation among each state, province, city and district;
(4)    Supervise the litigation which involves federal law or international treaty;
(5)    Accept case of litigation from court of each state, province, city and district to the highest federal court;
(6)    Case which is relevant to person who has diplomatic immunity;
(7)    Case of federal which is served as the parties;
(8)    Decide disputes among state, province, city and district which are relevant to jurisdiction;
(9)    Case which is relevant to sea and air jurisdiction.

Article 69 Each judicial branch of state, province, city and district has the obligation to cooperate with all the judgments and decisions from federal court.

Article 70 The federal court judge is nominated by federal premier and assigned after the consent of federal institutes. Federal court judge tenure for life, and cannot be suspended, transferred or dismissed. The retirement age is decided by law.

Article 71 During the tenure of federal court judge, one cannot serve as executive branch or congress senator; the judge cannot profit-winning industry; the judge cannot participate in political movement.

Article 72 Funds of federal judicial branch is special outcome of federal general budget.

Article 73 The case on trial should be done publicly, except for additional lawful regulation. Judicial decision must be announced publicly.

Article 74 Citizen have the right to institute legal proceeding with one’s native language. Judicial documents of ethnic group must use nationwide and common-use word.


Chapter 8 Implementation and Revision of the Constitution

Article 75 This constitution is effective when it is approved by constitutional convention. The amendment of constitutional article should be issued by one third of national or federal institutes’ senators, and be consented by three fourth of all the senators of the two houses and one half of legislative branches of state, province, city and district; the amendments of constitutional articles which are related to autonomous state and special administrative region have to be passed through relative legislative branches of autonomous state and special administrative region.

Rally on Strongly Protest against CCP’s Arresting CDP Member Wang, Rongqing

[China Democracy Journal](Article/NY Editor) About 11:00 a.m., on 27th, January, 2009, there were more than one hundred CDPWU members held a rally in front of Consulate-General of the People’s Republic of China in New Yorkin cold wind to develop “Propagandistic year of rescuing Chinese political persecuted” series movements 3: Strongly protest against CCP arresting CDP member Wang, Rongqing and claim CCP to release all the imprisoned CDP members immediately. Chairman of China Democracy Party and China Democracy Party World Union, <China Democracy Journal> proprietor Jun Wang took part in today’s rally and made an important speech.
China Democracy Party member 67-year-old Wang, Rongqing, has always devoted himself enthusiastically into Chinese democratic cause, and he attended Xidan Democratic Wall Movement in 1978; he edited and published periodicals, such as <Four Five Monthly> and <East China Public>, etc; and he also threw himself into students democratic movement in 1989 and took part in establishing China Democracy Party. On 26th, June, 2008, Wang, Rongqing was interned by the reason of “subversion of state power” for criminal detention, and was arrested on 31st, July.
CDP, CDPWU chairman and <China Democracy Journal> proprietor Wang, Jun made the important speech and said that China Democracy Party is the ever biggest anti-party in China, it has always insisted to express democratic freedom philosophy and strived for Chinese people’s freedom, democracy, fairness and justice by the way of opening-up, peace, rationality and non-violence since party’s establishment in 1998. China Democracy Party opposes terrorism, violent regime and all persecution; it advocates realizing democracy, freedom, human right and rule of law in China.
Wang, Jun said that there were lots of CDP members basically had abundant lives and happy families, but they were brutally persecuted by Chinese Communist Party for struggling against CCP’s one-party autarchy to promote Chinese democratic cause; many of them were separated from their wives and children, and their families were broken. These courageous CDP members were never turned back and with no regrets. Mr. Wang, Rongqing is one of those who struggled in the front line for Chinese democratic free right over a long period of time. Elderly Wang, Rongqing suffered both disease and poor. However, his great ideal for realizing China democratic cause has not changed.
Wang, Jun said that Mr. Wang, Rongqing is an excellent China Democracy Party member, and he has a high sense of responsibility, moving spirit of democratic freedom. Also, he dares to struggle with Chinese Communist autocracy for defending free democracy and safeguarding human rights.
Wang, Rongqing was sentenced 6 years of felony when Chinese government advocated “establish a harmonious and people-oriented society”. This is a tragedy for a country, and this is also a nation’s sorrow.
Today, we overseas CDP members gathered in front of Consulate-General of the People’s Republic of China in New York to strongly protest against CCP’s tyranny and claim CCP authorities to release CDP member Mr. Wang, Rongqing immediately, give freedom back to Mr. Wang, Rongqing!
A couple of CDP members made a speech in the rally to protest CDP arresting CDP member Mr. Wang, Rongqing, and strongly claimed CCP to release Mr. Wang, Rongqing immediately.

[China Democracy Journal](Article/NY Editor) About 11:00 a.m., on 3rd, February, 2009, there were more than one hundred CDPWU members held a rally in front of Consulate-General of the People’s Republic of China in New York to develop “Propagandistic year of rescuing Chinese political persecuted” series movements 4: Strongly protest against CCP arresting CDP Liaoning Department leader Kong, Youping, and claim CCP to release Kong, Youping immediately. Chairman of China Democracy Party and China Democracy Party World Union, <China Democracy Journal> proprietor Jun Wang took part in today’s rally and made an important speech.
China Democracy Party member Mr. Kong, Youping lives in Anshan, Liaoning Province, and he is a web writer and a freelancer. Mr. Kong, Youping has ever went to the countryside, been a worker, teacher and enterprise cadres. In 1998, Mr. Kong, Youping participated in establishing China Democracy Party Liaoning department and was cited by China Communist police. He was arrested after that time. After Kong, Youping was arrested by China Communist authorities on 13th, December, 2003, and he was sentenced with 15 years of felony by reason of “subversion of state power” from China Communist authorities on 16th, September, 2004.
Chairman of China Democracy Party and China Democracy Party World Union, <China Democracy Journal> proprietor Jun Wang made speech in the rally, and he said that Kong, Youping is a China Democracy party member with firm belief; he is merely a scholar. He released commentary, expounded thinking, propagandized democratic freedom philosophy, he was just expressed his standpoint, but China Communist authorities unexpectedly sentenced him felony and put such a scholar into prison with “subversion of state power”.
Jun Wang pointed out that China Communist regime is an authentic national terroristic group. Due to this regime imposed violence to Chinese people and deprived them of their basic human rights in a long time, which resulted in a situation of farmers’ starvation, workers’ unemployment, and houses’ breaking-down, arrested for petition and no freedom for practice. These are all run counter to Chinese Communist government’s “Harmonious Society” which was always promoted and today’s “Hu and Wen New Policy”.
A couple of China Democracy Party members made speeches in the rally. They protested against China Communist government arresting China Democracy Party member Mr. Kong, Youping and strongly claimed to release Mr. Kong, Youping immediately, and appealed to end up China Communist one-party dictatorship in China as soon as possible. Establish a country with freedom, democracy, human rights and rule of law.

2009 Spring Festival is coming, and we China Democracy Party members extend our warmest wishes and the most sincere greetings to dear brothers and sisters, and fellows in the whole of China on the occasion of this late winter! We wish we can strive together to protect ourselves’ interests for Chinese progress in the New Year! For promoting this progress we have collected 5,000 USD to donate those China Democracy Party members who were imprisoned in China and to those human rights defenders who were persecuted by China Communist, including their families.
However, there are still three donors’ families we cannot contact, they are Ning, Xianhua (sentenced with felony by Shenyang China Court), Kong, Youping (sentenced with felony by Shenyang China Court), and Zhang, Lin (sentenced with felony by Anhui China Court).
Please inform their families the above donating news if someone knows where they are, and contact us immediately, so that we can give those donated money to them and let them have a happy Spring Festival.
Under this severe condition of current financial crisis, practical actions are needed to care about those sufferers. It is not an easy mission for us to achieve of course, but we will make it sincerely! We will make the greatest efforts as always to donate for expressing our love! We emphasize repeatedly: “To donate is to support China Democracy cause! It is also the best patriotic action!” We wish we can get together to care for those people who contribute for democracy and freedom! Because they are working hard for Chinese future! They dedicate their freedom for national freedom, we can never forget them! We must study and revere those warriors who struggle for freedom selflessly!
