The Chinese government should enhance the educational legislation, which refers to that the government implement the management by enacting kinds of educational legislations, decrees, statutes and educational policies through relevant departments aiming at making educational tasks have constitutions to abide by on policies, systems, funds, staffs, infrastructures and executive management, getting legislative guaranteed, and promoting the educational tasks develop normally.
From the point of the view of Chinese educational situation, the government pays attention to “people system” not “legal system” for a long time leading to the deficiency of educational statute and prominence of drawbacks of education system. On one hand, the educational funds are inadequate, the investment of the educational funds is imbalanced, teachers’ salaries are owed and the infrastructures are old fashioned. On the other hand, the level of the government’s educational management is low and the power is not under surveillance. The most salient behaviors are that the officials embezzle and appropriate the educational funds, charge the students receiving compulsory education, and consider education an industry.
The Chinese government should get down to enacting comprehensive educational legislation, putting the development of education under legislation and making sure that the education is developing methodically and that the malfeasances of officials are avoidable and that put the power under surveillance of system , meanwhile, combating educational corruption and investing limited educational funds on students. The fundamental method to solve these problems is resorting to legal system. Only legal system can make the functions of government educational management work, guarantee education works normally and give students good education.
