Lu,Yupeng: the Chinese Society Needs a Democratic Constitution

Birth of civil constitution is a significant progress of development in human civilization, symbolizing appearance of a civil society. Judicial power must be independent. No one, no organization, no government and no official can violate it.
However, in an autocratic society, even though there is law, there is no democracy. Although there is a constitution, it does not represent intention of the majority of citizens. The Chinese society has developed for several thousand years. Current China has made its way towards a modern civilized society. Such a society is shocked and purified by democratic constitutionalism in the world, which forces the CCP government to advocate “constitution” in order to compromise with the public. The current constitution made by the CCP is a government designated one, which contains many items to beguile the public.
For the sake of truly representing the public opinion,a constitution can only be decided by the public.On one side, legislation power is stipulated by constitution; on the other side, executive power and judicial organization can restrict legislative power. Once a constitution is passed, it will possess the highest legal power. Such a constitution is a democratic one. The Chinese society needs such a democratic constitution.
