Li,Xueliang : Judicial Independence Relates to the Success of China’s Political Reform

China is an autocratic country, the Constitution regulates the communist party owns supreme power. Almost all positions at all levels of government and military are occupied by members of the communist party, which is a typical character of Chinese communist party’s one party system. The power under the one party authority is bigger than law, and the power is above the law, which is the fundamental reason for the judicial injustice of Chinese society; Judicial injustice would definitely lead to officials violate the law when they enforce the law. Criminals and their families can bribe in the judicial system and buy off judges.
The Chinese judicial system has many supervisory agencies, besides the public security organs, the committee of discipline investigation and the anticorruption bureau are also supervisory agencies. However, the supervision of these supervisory agencies is for themselves. This caused the supervision lacks effective checks and balances, and became a genuine speciosity. No wonder the judicial system is corrupted.
Nowadays, Chinese government officials bring forward political reform repeatedly on many public occasions, judicial reform is an important part of political reform; China’s judicial reform will receive more attention. How far the judicial reform can go and with what pace have fundamental influence on China’s political reform; judicial independence is the ultimate target of judicial reform in China. Therefore, the judicial independence concerns whether the political reform will succeed or not.
