Jiang,Pu:Appeals won’t stop if the structure doesn’t change in China

On October 2, 2010, China Democracy Party members lead by Chairman Wang,Jun went to the front of Chinese Consulate General to protest persecution of people who appeal to the higher authorities of CPC for help and support them, shout loudly to encourage movements to maintain their rights. In the afternoon I listened to the Chairman’s study democracy seminar in the party headquarter, and I couldn’t calm myself for a long time. I felt a stone in my heart which made me depressed. I need to get it off my chest, and let CPC hear of China Democracy Party members.
A pathetic appeal is my summary of the cause, process, and result of appeal. From my perspective, it’s pathetic no matter in which stage. The following is the cause of a pathetic appeal.
Appeal in ancient times is called “bring an accusation against someone before the emperor”, which means the appeal is directly submitted to the Emperor through relevant agency or blocks the Emperor’s imperial tour and hand over the appeal. It’s an inevitable outcome of the feudal system, and non-return road for common folks and vulnerable group; they turned all their hopes on the emperor. Every place under the sun belongs to the king. Everything in the world belong to the Emperor, local officials are representatives and slaves of Emperor, and maintainers of Emperor’s interests, local magistrate of the common folks. So how can children charge their parents? That is unfilial and guilty. Regardless of the correctness of common people, impiety is crime; they were punished first and convicted later. If you say there are no justice and law, he will tell you he is executing law and he is law. Under such circumstances bring accusations before the Emperor is on the road to ruin, how pathetic is that?
Let’s see the modern way which we call appeal. Right after the establishment of China when the inner war was just over and everything needed to be reconstructed, means of production and management experience of national capitalists were needed and were took away by force and had joint state-private ownership, private ownership were gone and nationalized, do you dare you are unwilling and dare to fight? Even discontent is not allowed. If you have dissatisfaction, that is anti-communism and hate the new China. The hard-earned opportunity to air one＇s views freely will be get even later, anyone who do that are right wings. How pathetic is that!
Look at the recent ten to twenty years. Everything is focused on economy and interests. CPC is still the original CPC, laws are still laws stipulated by former CPC, but added “private property” in the constitution. Those poor people can only choose the non-return road of appeal to defend their slender property. Local officials of CPC on the other hand persecute people who appeal to higher authorities and strike them mentally to maintain interests of CPC. Sun,Dongdong, a professor in Peking University once said 99% people who appeal were mentally ill, Liu,Qingning, vice director of deputy to the national people＇s congress once proposed to categorize appeal action to disturbance of public order, and can be sentenced 3 to 15 years in prison. How terrible is that! These people go against the tide of history and hold the candle to the devil.
Now we can see that ancient appeal or modern appeal have a common social background: autocratic, privileged society. The country doesn’t belong to people, but individuals and a certain party. In such society laws don’t have authority and public credibility. When people have unfair things they don’t rely on laws to solve problems and let justice prevail, but hope knight-errands, wise governors to uphold justice. That’s the most terrible and sad situation. Laws are the most powerful tool to maintain social order, and law is just a piece of paper once this tool loses credibility. Therefore, only a sound legal system, independent enforcement power, independent judicial system that’s not controlled by any individual or interest group, can protect people’s interest to the maximum. So the pathetic appeal is not caused by one or two corrupted officials, but the ultimate result of political system in a country. Lastly I want to say that appeals won’t stop without the support of a society that doesn’t have democracy, freedom, legal system, and equality.
