If the situation of human rights can be safeguarded and improved in China, the beneficiaries will be ordinary Chinese people and maleficiaries will be the government of CCP, officials and unscrupulous businessmen gaining big profits. Therefore, Chinese government tries their best to stop the improvement of human rights in China, and it shows why the regulations listed in the Chinese Constitution can’t be taken into practice.
The Constitution has been formulated by Chinese government for more than sixty years. During this period of time, it has been reformulated for many times, and “the country should respect and safeguard human rights” was ever written in the Constitution of P.R.China. But is there any improvement of human rights in China? The answer is No. The present situation in China is always stayed in the situation of “with Constitution but without Constitutionalism”.
If people want to promote the improvement of human rights in China in fact, the clause of limiting the power of party in office must be added into Constitution. This can reflect the clause of guaranteeing human rights of Chinese people concretely, quit the power totally and stop persecuting human rights. In terms of clause of guaranteeing human rights, it can limit officials’ abuse of power restrict and punish the phenomenon of officials’ abuse of power not based on the laws to establish the improve institutions of human rights in China in laws.
