In the Chinese society which is long-term ruled by the Chinese Communist Party, legislative, judicial, and executive departments are not independent department; judicial department belongs to the executive department which is under Chinese Communist government’s direct regime. The legislative, judicial, and executive departments’ interest is the same, and also cannot be separated. Rights, responsibilities, and the relationship between departments are very vague. Due to a chronic lack of law system which is used for supervising the power of government and government officials, their power become stronger and stronger, which can even be above the law. The law has no such function—supervising government’ s power, and such actions, like people complains or suing the government, are deemed unlawful. Chinese Community government officials believe that executive can replace the law. Under this condition, power loses control, corruption emerges, and finally the whole situation is out of control.
Then what can be an effective way in restraining the unbridled official corruption? A good, reasonable social system is the fundamental condition of anti-corruption. If the Chinese society allow two or more than two parties to take turns in power, achieving the separation of legislative, executive and judicial powers, government officials’ power can be bound to law, and the government officials will be subject to supervision while using the power; the interest between all parties can be restrained, co-exist and be balanced. When the government and its officials use the public power, they have to be sure of the interest of the country and people.
