In many places in mainland China, party and government officials misappropriate public funds for illegal and disorderly activities, which has caused great financial losses in China. The main reason why this phenomenon occurs frequently is that there is no decentralization system.
In a democratic country, government budgets and expenditures are public funds, which are strictly monitored and reviewed by parliament, and government officials cannot use them at will.
However, under the party-state system in mainland China, power is concentrated in party committees at all levels, and the National People’s Congress cannot effectively monitor local fiscal expenditure, so embezzlement of public funds will occur repeatedly.
According to the provisions of the Chinese Criminal Law and relevant judicial interpretations, state employees who take advantage of their positions to embezzle large amounts of public funds and engage in profit-making activities constitute a crime of embezzlement of public funds and are subject to criminal penalties.
However, despite the strict legal regulations, the misappropriation of public funds in mainland China has been repeatedly prohibited, indicating that without political system reform, even enacting laws and regulations will not help.
