Shao,Yixiao:Only the rule of law can restrict official corruption in China
邵一校(Shao,Yixiao)
China’s history has always been the rule of man, today’s China is no exception. China needs to establish a rule of law society; the genuine rule of law system is neither hypocritical nor differentiated, it should be impartial and unbiased, the rule of law society must provide a righteous platform for those who seeking justice. The Chinese government has been advocating to establish a society ruled by law, but that the rule of law society without democracy is only castle in the air, the moon in the water, it is unrealistic. At present, China does not have a sound legal supervision mechanism, as a consequence, the Communist Party of China (CPC)’s officials dare to abuse the public power, trample on ethics, and embezzle the public funds. The root of the problem lies in the fact that the Chinese government is the maker of the law, the executor of the law and the supervisor of the law. The ambiguity of the government’s role and function led to the absurd situation in China today. The Chinese government should implement the separation of legislative power, administrative power and judicial power, the government should define its own functions, and the government should not override its jurisdiction which defined in the constitution.
