In contrast, the National Defense Law of the People's Republic of China was enacted in 1997. Although the law was enacted according to the Constitution, there is a clear definition of content that is at least inconsistent with the Constitution.
Article 17 The armed forces of the People's Republic of China belong to the people.
Its mission is to consolidate national defense, resist aggression, defend the motherland, defend the people's peaceful labor, participate in the nation's construction cause, and serve the people wholeheartedly.
Article 18 The armed forces of the People's Republic of China must abide by the Constitution and laws and adhere to the rule of law.
Article 19 The armed forces of the People's Republic of China are led by the Communist Party of China.
The Communist Party of China in the armed forces conducts activities in accordance with the Constitution of the Communist Party of China.
It is worth noting that Article 19 of the Act and Article 93 of the Constitution respectively stipulate that two different institutions and organizations lead the armed forces.
